Roundup: The limits of Trudeau’s patience

Late in the day yesterday, Justin Trudeau announced that he had come to the limit of his patience, that his calls for dialogue were not being heeded, and that it was time for the barricades to come down – something that was hinted at during Question Period a couple of hours earlier when the parliamentary secretaries sent to recite scripts said that “dialogue has its limits.” Trudeau did not say how those blockades were to come down – he wasn’t issuing orders to police, given that the enforcement was a matter of provincial jurisdiction, but part of the call was for Indigenous leadership to basically get their own people to stand down (though that didn’t seem to go so well on Wednesday after one Mohawk grand chief had to walk back his calls for de-escalation). And while some of the premiers, Scott Moe included, said they were pleased by the changed message, Doug Ford continued to blame Trudeau for things happening in his own backyard.

In the hours after the press conference, one sympathetic blockade south of Montreal was abandoned when riot police showed up to enforce the court injunction there. And in BC, the province’s Environmental Assessment Office suddenly told Coastal GasLink that they needed to engage in further consultations with the Wet’suwet’en people, since deficiencies in their previous efforts were pointed out to them over the course of the past couple of weeks, and were given 30 days to do so, which could further de-escalate the situation as the RCMP are moving out of their enforcement operations. But at the same time, that same group of hereditary chiefs has been shifting their demands, so that one minute on TV they’re saying the RCMP physically removing themselves from those operations was enough to start talks, the next minute putting out a press release saying that the RCMP needed to be out of their territory entirely, including routine policework, and then telling a radio station that because of Trudeau’s statement that they’re going to delay talks even further – all things that seem to me to further bolster Trudeau’s position that he’s been the reasonable one and the other side hasn’t been. And as for all of those people who insist that Trudeau is simply saying what Scheer did four days ago are ignoring the very important nuances of what has happened, as Andrew Coyne points out below.

As for the handwringing by the likes of Scheer and Jason Kenney that these protests send a signal that things can’t get built in Canada, perhaps the signal is that things can’t get built the same way, cutting corners and running roughshod over these First Nations like they used to be able to. It’s like people who lament that we couldn’t build the railways these days, who seem to blithely ignore that said railways were built by displacing First Nations along its path, and importing virtual slave labour from China to do the work. If they think that’s the kind of thing that would fly today, then perhaps they need to give their heads a shake.

Meanwhile, Chantal Hébert worries that these protests were the “dress rehearsal” for future protests against the Trans Mountain construction, however I have a feeling that there are enough points of difference between the facts related to Wet’suwet’en territory and the Trans Mountain route that it will wind up playing very differently if that were to happen. Matt Gurney delves into the logistics and supply chains that depend on the rail corridors in this country, and how vulnerable the blockade has made us. Gurney also has a very good three-part series on Wet’sewet’en law and how it relates to the situation, which is well worth your time (parts one, two, and three). Paul Wells is dubious about Trudeau’s four-day limit to his patience, and the signals that it sends.

Roundup: Escalating costs for compliance

The over-the-top rhetoric over energy projects in this country hasn’t been limited to the Teck Frontier mine decision. No, we got a new round of it yesterday when Bill Morneau disclosed that the Trans Mountain expansion pipeline costs have increased to $12.6 billion, in part because of environmental changes and accommodations for local First Nations. Predictably, both the Conservatives and project opponents lost their minds – the Conservatives melting down that this was somehow because of this government’s delays (erm, you know there were court processes in between, right?), apparently oblivious to the fact that this was the cost of compliance to get it built; the opponents because of the increased price tag over a project that they are certain will increase carbon emissions (even though it is more likely to decrease them as those contents would simply flow by rail otherwise). Jason Kenney, of course, takes the cake for his own outsized rhetoric on the matter.

From Washington DC, Kenney and his Mini-Me, Scott Moe, were both being remarked upon for how toned down their rhetoric has been of late (which I contend has to do with Trudeau and Freeland calling their bluff on their “equalization” bullshit), but they certainly kept up it up around Teck Frontier, and Alberta’s environment minister was thundering about the news reports of a possible federal “compensation package” if the approval was not granted – which was, of course, full of lies about the merits of the Teck proposal. And the notion that the federal government simply needs to “get out of the way” pretends that the biggest woes are the price of oil, and the fact that the US shale boom has hobbled the viability of the oilsands.

Meanwhile, Heather Scoffield makes note of the fact that all reason has gone out of the “debate” over the approval of the Teck Frontier mine. As if to illustrate the point, Matt Gurney repeats a bunch of the well-worn justifications for approving the project under the notion that Alberta needs jobs and not bailouts, without seeming to recognize that it’s not currently economically viable, while ignoring that delays to TMX were not because of government action but Indigenous court challenges under their constitutional rights, or that there is a reason why the Conservatives ensured there was Cabinet sign-off on these decisions. Chantal Hébert points out that the Liberals will lose whichever way they decide on this project.

Roundup: Middle Class™ is a state of mind

I don’t really want to engage in a pile-on, but the fact that the new Minister of Middle Class™ Prosperity® was doing the media rounds and imploding on trying to offer a definition of just what is Middle Class™ was not a good start to her ministerial career – not to mention an indictment of the comms geniuses in the PMO who sent her out there unprepared. You would think that actually having a working definition of what is “middle class” would be an important thing to equip a minister with when you give her the portfolio – particularly when you wrap up an otherwise sober role of Associate Minister of Finance with this ridiculous title. And there are a couple of very serious points to make here – if you can’t actually define what “middle class” means, then you have no actual way of measuring your success in dealing with the perceived issues of income disparity – which this government has been using Middle Class™ as a code for without trying to sound like they’re engaging in class warfare. But as a branding exercise, when you rely on the fact that everyone thinks they’re “middle class” or about to be – particularly people who are well over what is actually middle class in this country – it’s one of those things that tends to flatter people, but becomes meaningless – essentially that Middle Class™ is a state of mind. Mona Fortier did, over the course of the day, transition from “it involves your kids being in hockey” to “there’s no one definition” because of regional variations and disparities, but it was a bit of a trial by fire, and hopefully a lesson that she – and the comms geniuses in PMO – will take to heart.

All of this talk of being Middle Class™ does bring me back to this scene from the early noughties UK sitcom Gimme Gimme Gimme, where being Middle Class was a Thing.

Meanwhile, Chris Selley makes the very salient point that this government has moved the needle on poverty in this country, but the problems we’re facing aren’t with the Middle Class™, and perhaps they should put a focus on those areas instead.

Roundup: Holding up a mythical threat

The first day of the new Cabinet, and Justin Trudeau, along with Chrystia Freeland and Jim Carr, had their first meeting as a group with Calgary mayor Naheed Nenshi, who held up the now-former Bill C-69 as the source of much of the anger in Alberta, and his demands that it be changed. The problem here – and Nenshi acknowledged – is that the pre-existing system that Stephen Harper’s government put into place in 2012 did not work, and Nenshi could list projects being held up by it, which is all the more reason why his strident condemnation of the new assessment system is all the more baffling. Part of the problem here is that the bill – along with the now-former C-48 – have been used as scapegoats for the frustrated economic ambitions of the province. Never mind that C-48 was largely symbolic – there is no pipeline project that would head for the northwest coast of BC, nor is there going to be, and no, Northern Gateway is not going to make a comeback because the obstacles identified by the Federal Court of Appeal were almost certainly insurmountable. And C-69 is in no way a “no more pipelines” law.

I talked to a lot of environmental lawyers on both sides while C-69 was being debated, and the biggest source of unease on the proponent side was the uncertainty as to whether the legislated timelines would have the problem of issues stopping the clock – thus dragging out those timelines – much of which was alleviated when the draft regulations were released. Again, the talk about the carbon budget in the bill was clarified in the regulations, which also alleviated many of their concerns (and caused some on the environmental side ulcers). So while the government is now talking about tweaks to the regulations, that seems more than entirely appropriate for the reality of the situation, and their refusal to scrap the law is entirely rational and just.

The problem becomes fighting the narrative that has been created around this law, and the fact that it has grown into a mythological terror is what they will have to grapple with – and compounding this is the fact that this government has proven itself time and again to be utterly incompetent at communications. For as much as Catherine McKenna did some good work when she was the minister, she kept repeating the tired slogan of “the environment and the economy go together” and other nonsense talking points (and then insisting that she spoke like a regular person), which did nothing to counter the lies being promulgated by Jason Kenney, Andrew Scheer, and others, about what was actually in the legislation. And you can’t fight lies with canned talking points. I wish this government – and the communications geniuses in the PMO most especially – would get that through their heads, which is why trying to placate the anger when it’s being directed at the mythology and not the reality of this legislation is going to be an uphill battle.

Roundup: Humble and concerned

The Liberals had their post-election unofficial caucus meeting (technically true that it can’t be an actual caucus meeting as Parliament has not been summoned and only a handful of MPs have actually been sworn in yet), and the early results are that they need to be more “humble,” and address the concerns of Western Canada – somehow. Particularly because squaring the economy versus environment circle is harder in that part of the country (though really, the world price of oil is the bigger problem for them right now than any amount of environmental regulation could ever be). And like Scheer, there is this emphasis on the need for some kind of “listening tour” of the region, though I have my serious doubts about the utility of it given that the demands being made of the federal government are largely nonsensical, counter-productive, or non-starters (and many are being made intentionally so by the likes of Jason Kenney and Scott Moe because they want federal inaction on those specific items to be things they can get people angry about).

With this in mind, there were two interesting pieces out yesterday – one, a retrospective from Rosemary Barton about the recurring nature of Western anger, which has been around for decades and the fact that the Liberals have often been shut of the region in terms of seats, even worse than they are currently, and yet the country mas managed to survive. The other piece, from Jen Gerson, is a lengthy and exasperated piece that tries to shift some of the blame for the sentiments on the narratives that spring out of Central and Eastern Canada about Alberta, and how those contribute as much to Western alienation than anything else. And while Gerson makes some really good points in her piece, I did find it a bit one-sided in several respects, because it ignores some of the attitudes in the province that are just as off-putting to the rest of the country, from their smugness, their patronizing attitudes about how other regions facing unemployment should just decamp to the oilsands (which is ironic now that other regions are facing labour shortages but I don’t see a lot of Albertans eager to move there), their hostility towards Quebeckers (which many pundits raised as a factor in the return of the Bloc in this election), and this sense of entitlement that it was their hard work an ingenuity that put the oil under the ground rather than an accident of geology. And yes, I am an Albertan and I grew up with these attitudes as much as I did the feeling of being put upon by the rest of the country, or the grand mythologies we built up for ourselves about Pierre Trudeau and the National Energy Programme, and the conflation with the collapse of world oil prices that happened at that time.

Another of Gerson’s recurring themes is her insistence that Jason Kenney is simply trying to replicate Preston Manning’s attempt at channeling the province’s anger into a more productive course of action – forgetting that Manning’s Reform Party did serious damage to the institutions of Parliament, which have never recovered, or the fact that Kenney is not channeling those feelings in any productive way, but deliberately stoking anger through lies and snake oil promises for his own benefit. This needs to be identified and called out, and it needs to be done repeatedly and forcefully because Kenney will simply double down and bulldoze over anyone who challenges him over his bullshit – which makes it all the more important that it be challenged again and again. Giving him a pass because he says he’s a federalist and a patriot (while also sounding like a movie mobster running a protection racket) will only make it fester.

Roundup: A quasi-exit for May

The other, non-Senate big news on Parliament Hill yesterday was Elizabeth May’s decision to step down as Green Party leader – sort of. She said that she would stay on as the “parliamentary leader,” but give up the mantle of big-P Party leader, and that one of her appointed deputy leaders, Jo-Ann Roberts, would be interim leader until the party could have a leadership convention – next October. May fully intends to stay on as an MP and run again as an MP (and said that she would not run for Speaker this time, but would pursue it in the next Parliament).

This particular kind of leadership dynamic is part of what ails Canadian democracy right now – this notion that there should be year-long leadership races, and that someone who doesn’t have a seat in Parliament should be leading the party in any capacity. The fact that the leader is not selected by caucus alone is one of the biggest problems with our system – it has allowed leaders to centralize power and when they get into power, that centralization rests in the PMO. And with May stepping back, and new MPs Jenica Atwin and Paul Manly also eschewing running for the role, they will again be a party where their leader is outside of Parliament, and who may or may not run for a seat anytime a byelection comes around, and they will face some of the challenges that Jagmeet Singh became all too familiar with.

There needs to be a rebalancing of leadership roles in our system, and we need to keep the party leader’s focus back on parliament, with the rest of the leadership better handled by the Party president. But what the Greens are doing now is just perpetuating what is horribly wrong with our system.

Meanwhile, Susan Delacourt remarks on how May left on her own terms, while Paul Wells sees the end of May’s leadership as a chance for her party to overhaul its message and its organizational abilities.

Roundup: Admitting the need for negotiation

With the policy-over-controversy reset now in full swing, Justin Trudeau was out first this morning in Hamilton to announce next steps in the government’s planned universal pharmacare programme, with a $6 billion “down payment” in the system, along with more funding for increased access to family doctors and mental health services. Unlike other campaigns – looking specifically at you, NDP – this one was honest in the fact that it would rely on negotiations with the provinces, and that it would be incremental (something the NPD promise handwaves over), though where Trudeau got into a talking point was where he kept bringing up Doug Ford in this, and asking who Canadians trusted to negotiate with Ford – Scheer, or him? And he repeated it over, and over, and over again, to the point of parody.

Andrew Scheer was in Vaughan, Ontario, to announce a four-point plan to make housing more affordable, which included a plan to “fix” the mortgage stress test (erm, have you read anything the Bank of Canada has put out?), let first-time homebuyers take out thirty-year amortized mortgages (almost like the 2008 financial crisis didn’t happen!), launch a national enquiry into money laundering in real estate, and make surplus federal real estate available for developers. The first two seem to ignore the actual issues at play regarding bad debt and the past financial crisis, and has instead swallowed the arguments of real estate lobbyists wholesale – never mind that the housing market has come roaring back in recent months, showing that the stress test was not the issue, and it’s almost like these plans could have the effect of driving up housing prices again. Funny that. Like Trudeau invoking Ford, Scheer was also invoking Kathleen Wynne’s name as his own scare tactic, which seems like a poor choice considering that her government has already been defeated, and Ford was found to have mislead Ontarians on the size and scope of the deficit (while he spends more at the same time as cutting services).

Jagmeet Singh finally visited New Brunswick for the first time in the 23 months he’s been leader, where he announced a “star candidate” (very loose definition), apologised for not having visited sooner (offering no excuses), and repeating his plans for pharmacare – again, with no details about how exactly he’d get the provinces to sign onto a very expensive programme with disparate systems and formularies within a year.

In an interview broadcast yesterday, Singh also said that he would allow any province to have a veto over projects like pipelines, which is also ridiculous, goes against the whole notion of why we have a constitution, and also goes against his whole platform where he wants to impose federal programmes on areas of provincial jurisdiction (being pharmacare and dental care).

Roundup: Figures without context for outrage

You may have noticed that the Conservative Party’s Twitter feed recently is trying to make “100 days of Trudeau fails” a Thing – because their overriding narrative has been to put “Trudeau” and “fail” in the same sentence for the past two years now, but it still feels a lot like trying to make “fetch” happen. But as they essentially regurgitate old headlines as part of this campaign, you will find that most of the posts are missing key context, which ensures that it’s often a big figure with nothing to support it. Given that We The Media have trained Canadians with our fixation on cheap outrage stories, I’m sure this is a tactic that they feel is a slam dunk, but in any case, here are a few examples from the past few days. In other words, don’t take anything at face value, but remember that there is context (that is easily Googled) to what they are posting, and most of it makes them look pretty petty – particularly the repairs and upgrades to the official residence at Harrington Lake, given that Trudeau has been entertaining foreign leaders there as they can’t do it at 24 Sussex.

Roundup: Ending a sitting on a witch hunt

Alberta’s legislature wrapped up its session last night, and it saw the passage of bills that included rolling back protections of LGBT students in schools, changing overtime rules and cutting wages for students, not to mention Jason Kenney spending millions of taxpayer dollars to promote conspiracy theories and to conduct a witch-hunt against people who say mean things about the oil industry. So much of it would be cartoonish if there wasn’t such a worrying trend of Kenney simply lying to keep his population angry. And if you pay close attention to this Postmedia wrap-up of the sitting, it doesn’t call out the moments when Kenney egregiously lied (especially around the stunt with the ear plugs) and the story just both-sidesed the whole thing. We’ve taught them that they can get away with lying, so they’re doing it with impunity.

Roundup: Nepotism versus Responsible Government

As the nepotism scandal in Ontario picks up steam, with revelations that there were appointments made to lacrosse players and an MPP’s father, and more demands that there be a more independent review of the appointments that have been made, I think it’s time for a bit of a civics and history lesson about patronage appointments. In many ways, patronage appointments are how we wound up with Responsible Government in the colonies that became Canada in the first place – the local assemblies wanted control over who was being appointed to these positions rather than them going to people from the UK who would then come over to carry them out, and eventually we won that right as part of Responsible Government. It was also understood at the time that it was fine if the party in power put their friends into patronage positions because when fortunes turned and their rivals formed government, they would be able to do the same with their friends. That particular view we have, fortunately, evolved from.

Regardless of this evolution, the core fact remains – that under Responsible Government, it is the first minister and Cabinet who makes these decisions as they are the ones who advise the Governor General/lieutenant governor to make said appointment. It also means that they are accountable to the legislature for that advice, which is where the current nepotism scandal now hangs. There are going to be all kinds of Doug Ford apologists who say that this was all Dean French, that Ford didn’t know what was going on – even though he signed off on it. And that’s the thing. It doesn’t matter if this was French hoodwinking Ford because Ford is the one who advises the LG about the appointments, and Ford is responsible to the legislature for making those appointments (and for hiring French, when you think about it). And if his party gets too embarrassed by this particular scandal, well, there could be a loss of confidence in the offing (likely from within party ranks than the legislature, but stranger things have happened).

On that note of accountability, we should also point out that with the appointment of yet more ministers and “parliamentary assistants,” there are a mere 27 MPPs left in the back benches who don’t have a role, which means that they will see themselves as one screw-up away from a promotion (and this is more salient in the provinces, where regional balances are less of an outright concern, and this government in particular seems less interested in other diversity balances). That does erode the exercise of accountability by backbenchers. So does, incidentally, a chief of staff who would berate MPs for not clapping long enough, but maybe they’ll grow a backbone now that French is gone. Maybe.
