QP: The other conspicuous silence

For the final QP of the spring sitting (barring unforeseen circumstances), all leaders were present, and plenty of MPs kicked off with statements of thanks to spouses and supporters. Andrew Scheer led off, mini-lectern on desk, reading congratulations for his new MP, before reading some aged talking points about the India trip. Justin Trudeau first congratulated the new MP, and thanked the pages and the Commons staff, but didn’t respond to Scheer’s question. Scheer read the laundry list of the prime minister’s supposed sins, worried about his reckless spending. Trudeau responded with a reminder about the investments they have made in the middle class. Scheer breathlessly read the costs of upgrades to the PM’s residence at Harrington Lake, and Trudeau stuck to his talking points about investing in the middle class, avoiding Scheer’s bait. Scheer tried again, and this time Trudeau took up a script to talk about the NCC’s responsibilities in maintaining official residences. Scheer tried yet again, and Trudeau sanctimoniously talking about all of the problems facing the country and the world, while that was what Scheer was focused on. Guy Caron was up next for the NDP, and demanded to know if the US was still considered a safe country for asylum seekers. Trudeau took up a script to respond that Canadians are concerned, and they were looking for ways to modernize the Safe Third Country Agreement, and they were monitoring the situation. Caron demanded that Trudeau denounce what was going on, to which Trudeau reiterated that the situation was unacceptable and they were monitoring it. Jenny Kwan took over in English, louder and angrier, and Trudeau took his script back up to repeat that what’s happening is wrong, and that he would stand up for those seeking refuge. Kwan tried one last time, and got the same answer.

Roundup: A strained partisan detente

There is a strange partisan cold war settling over the nation’s capital, as both government and opposition try to put up a united front against the Trumpocalypse, while at the same time not looking to give up too much advantage, and so they probe areas where their opponents may be weak, but that they won’t look too crassly partisan in exploiting it, kind of like Erin O’Toole did last week when the steel and aluminium tariffs were first announced. The Conservatives and NDP are trying to probe the previous statements about Supply Management “flexibility,” while the Liberals are essentially calling Maxime Bernier a traitor as he starts speaking about his opposition to the system once again. It’s not pretty on either side, and yet here we are.

While Trump has threatened auto tariffs, I’m not sure that’s even remotely feasible given how integrated the whole North American industry is, and those tariffs would not only devastate supply chains, but it would have as many adverse effects on the American industry as it would the Canadian one. Of course, we’re dealing with an uncertainty engine, so we have no idea what he’ll actually do, but hey, the government is working on contingency plans that include further retaliatory measures if these auto tariffs come to pass. As for Trump’s focus on dairy, here’s a look at the size of subsidies that the American dairy industry is awash in. Brian Mulroney, incidentally, thinks this is all a passing storm, for what it’s worth.

Because there are so many more hot takes about developments, Andrew Coyne thinks that there should be debate on how to best retaliate to American threats rather than just rally around the PM. Chantal Hébert notes that Trump has essentially boxed Trudeau in with regards to how he can respond to the threats. Martin Patriquin counsels patience with the Trumpocalypse, so that we don’t go overboard thanks to a few intemperate tweets. Chris Selley notes the sudden burst of solidarity and hopes that they don’t return to bickering over small differences once this crisis passes. Jen Gerson, meanwhile, notes that Trump’s attack are those of a bully trying to pick on a weaker target, but forgets that Canada isn’t weak – we’re just passive aggressive. Gerson was also on Power & Politics(at 1:08:35 in the full broadcast) to say that her genuine fear out of all of this is that it’s all a sideshow designed to turn Canada into some comic enemy for Trump to run against in the upcoming midterms, and I suspect that she’s onto something, and we may be playing into Trump’s hands when if we get self-righteous in our response.

Roundup: Trans Mountain decision day?

It looks like today will be the day we get some kind of answer on the Kinder Morgan Trans Mountain expansion pipeline, and everything will likely be confirmed in the morning as Cabinet meets earlier than usual. The three options on the table are the previously announced indemnification, as well as the option to either buy the pipeline outright (though I’m not sure if that means just the expansion or the original pipeline itself that the expansion twins) in order to sell it once the expansion completes construction, or temporarily buying it long enough to sell it to someone else who will complete construction. The word from Bloomberg’s sources is that the government is likely to buy it outright, on the likely option of buying it long enough to find someone who can guarantee its completion.

As for what this will mean politically, you can bet that there will be no end to the howls of outrage from both opposition parties – from the Conservatives, we’ll hear that this never should have happened, and it’s only because of the federal government’s incompetence that it did. (While one can certainly question their competence in a number of areas, this is one where they had few good options, and no, a court reference or a pipeline bill would not have helped because they already have the necessary jurisdiction they need). The NDP, meanwhile, will howl that this is a betrayal of their promises on the environment and the rights of First Nations, and that it pays billions to “Texas billionaires” rather than Canadians, and so on (though one would imagine that the NDP should be all for nationalizing infrastructure projects). And one can scarcely imagine the invective we’ll hear from Jason Kenney, as helpful as that will be. Suffice to say, the next few days (and weeks) will likely be even more dramatic that they have been. Because this time of year isn’t crazy enough in Parliament without this.

Roundup: Not the constitutional crisis you were looking for

After much drama and back-and-forth between the two chambers, the Senate passed the omnibus transport bill yesterday after the Commons rejected their amendments a second time. Once again, we did not get the constitutional crisis that we were promised, and we’ll get a whole new round of back-patting that the Senate did its job, because at least a few of the amendments were accepted (even though the larger problem remains that many of the ones that were rejected saw no debate, nor were reasons for rejecting them provided other than the government “respectfully disagrees,” which is not a reason).

Amidst this, the Conservative Senate leader, Senator Larry Smith, penned a response in Policy Optionsto Government Leader in the Senate – err, “government representative” Senator Peter Harder’s previous op-ed about the apparent use of a Salisbury Convention in the Canadian Senate (which was false). The problem there, however, is that Smith didn’t really rebut anything about the Salisbury Convention or lack thereof. Rather, he went on about how the prime minister is trying to walk back on his promise of a more independent Senate by means of their rejection of the bulk of the amendments to the transport bill, and the apparent orchestration through Harder of a policy of trying to tell senators how to vote (as in, pass bills even though we say that we don’t want you to be a rubber stamp). And while I sympathise with many of his points, I’m not convinced by his overarching thesis.

Despite the fact that many a Conservative senator keeps trying to promulgate a series of conspiracy theories, from the fact that the new Independent senators are all just crypto-Liberals that are being whipped to vote a certain way, that they are trying to “destroy the opposition” in the Senate, or in this case, that the PM is trying to undermine his own pledge for independence via Harder’s patently unhelpful suggestions. But part of the problem is that on the face of it, none of these really stack up. While we can’t deny that many of the new senators have government sympathies, I wouldn’t consider them partisans in the same sense. The issues of their block-voting has more to do with their anxieties about accidentally voting down government legislation than it is about their being whipped to vote a certain way. And frankly, the biggest reason why I sincerely doubt that Trudeau is conspiring with Harder is the fact that there has been so little competence being demonstrated by Harder and his office when it comes to management of the agenda in the Senate that it seems more than implausible that there is any kind of coordination happening, particularly since I know that there are people in Trudeau’s and Bardish Chagger’s offices who know how the Senate works, and we’re not seeing their input. And the longer that the Conservatives keep pushing these woeful conspiracies, the more they undercut their own position on maintain a level of status quo in the Senate that is probably beneficial in the longer term. But they never seem to learn this lesson, and it may cost them, and the institution, as a result.

Roundup: An historic apology

As promised, Justin Trudeau delivered a long-awaited apology for those LGBT Canadians who had been persecuted and hounded out of jobs in the civil service, military and police forces as a result of government policies, and to go along with this apology will be some compensation. (The speech and video are posted here). As well, a bill was tabled that will expunge the records of anyone caught up in these processes, but as Ralph Goodale explained on Power Play, the bill requires an application as opposed to the government doing a blanket action, and won’t cover some of the other charges such as being a found-in during a bathhouse raid. That could set up for an interesting future legal challenge, for the record.

So who does this apology affect? Some examples heard yesterday include Diane Doiron, who spoke to Chatelaine about her experiences, or former sailor Simon Thwaites, who was on Power Play.

While some may dismiss the rash of apologies from the Trudeau government as “virtue signalling” or being soft, history shows that official apologies tend to come more from conservative sources than liberal ones. Aaron Wherry, meanwhile, notes that while the Conservatives did participate in yesterday’s apology, they have been making a lot of political hay of late trying to show themselves in opposition to those who would “denigrate” the history of Canada, or who constantly find fault with it rather than praising it uncritically. And yes, it is an interesting little dichotomy.

Those who say that the apology doesn’t go far enough, pointing to the ongoing blood donation ban facing gay men who have had sex in the past year (note: this is a change from the previous lifetime ban) still hasn’t been lifted as promised, the government did put in research dollars to ensure that the proper scientific evidence is there to lift it permanently. While critics say that this remains discriminatory, I remind you that previous governments had to pay dearly for the tainted blood scandals of the past, which is doubtlessly why the current government wants to ensure that all of their bases are covered and untouchable legally in the event that any future lawsuits from this change in policy ensue.

Regarding those Conservative absences during the apology:

During the apology speeches in the Commons, I and several others noted that there were a number of conspicuous Conservative absences – some 15-plus vacant desks, all clustered in the centre of their ranks, which looked pretty obvious from above (and this matters when you’ve got the galleries full of people who have come to hear the apology). I remarked on this over Twitter, and it created a firestorm, especially when I highlighted the vacant area on the seating chart. Some of these absences are legitimate – some MPs were away on committee business, and I got flack from some of them for that afterward, feeling that it was a cheap shot, and if that’s the case, then I do apologize. It wasn’t intended to be, but it was pointing out that the giant hole in their ranks was conspicuous, especially as this was not the case during QP, which immediately preceded said apology. I will also note that none of the Conservative staffers who monitor my Twitter feed (and I know that they do, because they constantly chirp at me by claiming I’m too partisan in my QP-tweeting), offered up a correction or explanation until hours later, which I would have gladly retweeted if provided one. They did not. I can only work with what I can see in front of me at the time, and if some of those MPs who were there during QP went to fill the camera shots on the front benches, that’s still a poor excuse for leaving a giant hole in the middle of their ranks that the full galleries can plainly see.

Roundup: Say no to written guidelines

In the pages of the Hill Times, recently retired Liberal Senator George Baker opined that he thinks the Senate needs written guidelines to restrict how bills can be amended or defeated. Currently, there is the constitutional provision for an unlimited veto, and a general principle followed by senators that they don’t defeat (government) bills unless it’s a Very Serious Matter because they know they’re not elected and don’t have a democratic mandate to do so. And as much as I appreciate the learned wisdom of Senator Baker (and his retirement is a tremendous loss for the institution), I’m going to solidly disagree with him on this one.

For one, our institutions in their Westminster model are predicated on their flexibility, which allows for a great deal of evolution and adaptability, and adding too many written guidelines to hem in powers – powers that were given to the institution for a reason – rankles a bit because there will always be situation for which those powers may become necessary to use. Too many guidelines, especially when it comes to amendment or veto powers for a body for whom that is their entire purpose, takes away their power and ability to do the jobs that they are there to do in the first place. As with the constant demands for a Cabinet manual to spell out the powers of the Governor General, it’s the first step in removing discretionary power, and giving political actors (especially prime ministers) ways to go around the other constitutional actors, be they the Senate or the Governor General, which is something that should worry every Canadian. As well, codifying those powers opens up the possibility of litigation, and you can bet that our friends at Democracy Watch are salivating for any chance at all to start suing the Senate based on their not living up to whatever guidelines are drawn up, thus further imperilling the exercise of parliamentary privilege and the separation of powers between Parliament and the courts. So no, I don’t think written guidelines are needed, nor would they be helpful. At least not from where I’m sitting.

Meanwhile the Senate’s Internal Economy Committee members published an open letter to Senator Peter Harder in response to his Policy Options op-ed on independent oversight for the Senate. Suffice to say, they weren’t fans. (My own response to Harder can be found here).

Roundup: Neglecting a vital institution

Of the things that vex me about our current government, their tacit endorsement of republican sentiment in this country is high on my list. The fact that they have allowed the Conservatives to take up and politicise the monarchist space in the Canadian landscape is shameful, and the fact that they have allowed the position of Canadian Secretary to the Queen to lapse is just one more sign of this particular antipathy. For all that he professes his affection for Her Majesty, Justin Trudeau seems to have a pretty difficult time reflecting that in his government’s particular decisions, and we will pay the price for it. That the work of arranging royal tours and being the link to Buckingham Palace is being left to the bureaucrats in Canadian Heritage is not a good thing. Everything I have heard about the job they do is not only that they are plagued with incompetence when it comes to the actual work of dealing with the Canadian Monarchy, but the tacit acknowledgement of my sources that those very bureaucrats charged with the responsibility are themselves republicans is hugely problematic. That they are the ones offering advice to the government is a very big problem. And that Trudeau appears to be neglecting this very important relationship is worrying. I know that there are monarchist Liberals in the ranks, and I hope very much that they can start to raise a fuss about this, because it’s a very worrying road that we are now on, and this kind of neglect can do lasting damage to our most fundamental institution, which we should all be very concerned about.

Meanwhile, Paul Wells had an exit interview with Governor General David Johnston, and brought up the issue of debating abolishing the monarchy. Johnston, bless him, pointed out that the countries that most satisfy the needs of their people tend to be constitutional monarchies, so we’ve got that going for us.

Roundup: Charles and Camilla in Iqaluit

Prince Charles and Camilla, Duchess of Cornwall, arrived in Canada, starting their tour in Iqaluit to talk about revitalising the Inuit language – project he has taken great interest in, and last year invited some Inuit delegates to Wales to hear about how they had success in revitalising the Welsh language there. While Charles’ official role in Canada is somewhat ambiguous now that we have a dubious succession law on the books (thanks to the previous government), he is nevertheless the heir to the Crown. The tour moves to Trenton and Prince Edward County in Ontario today, and Ottawa for Canada Day on Saturday.

Roundup: Amendment and attempted intimidation

As the spring sitting of Parliament draws to a close, and the Commons is getting tired and cranky as MPs are restlessly looking to get back to their ridings, all eyes are on the Senate to see if they’ll pass the budget bill unamended so that MPs can leave, or if they’ll be forced to stick around to deal with delays. It looks like the latter is going to happen after the Senate voted to adopt changes made at the committee that would remove the automatic escalator on beer and wine taxes. (There is some debate around this – while on the one hand there is the argument that increases won’t be scrutinized in future years by Parliament, there is also a reminder that the indexation fight was settled years ago).

So while this means that the Commons wasn’t able to rise last night, and may have to stick around until Thursday, depending on whether or not they pass it at Third Reading tonight, and how fast it takes the Commons to turn around a vote on accepting or rejecting (almost certainly the latter) the amendment.

But that’s not the only curious part of this tale. Apparently when the vote was about to happen, all manner of Liberal MPs and ministers arrived in the Senate to watch the vote happen – but not in the gallery. No, they were instead on the floor of the Senate, behind the bar at the entrance.

While this attempt at intimidation is quite unseemly in and of itself, I’ve also been hearing complaints that Senator Peter Harder, the Leader of the Government in the Senate – err, “government representative,” is admonishing senators not to amend bills this late in the game because recalling the House of Commons to pass or reject those amendments “is expensive.”

I. Can’t. Even.

Telling Senators not to do their constitutional duties of reviewing and amending legislation because it might inconvenience a few MPs is gob-smacking in and of itself, but couching it in dollar terms is beyond the pale. Apparently, we can only have parliamentary democracy if it’s done on the cheap. Why have oversight or hold the government to account if it’s going to cost any additional dollars? I guess we might as well pack it all in and roll over for the government – costs too much otherwise. Sweet Rhea mother of Zeus…

Update: It seems there were some Conservatives there as well.
