Roundup: Civilian control – it’s a Thing!

Over the past couple of weeks, as the government’s “interim” fighter acquisition plans were announced and the fallout has been filtering down since. I’ve seen a lot of fairly disturbing commentary around it, not just from some of the usual ass clowns on social media, but I’ve also seen it in the House of Commons. No less than Rona Ambrose told the Prime Minister that the government needs to get out of the way of military procurement decisions and let the military decide what it needs or wants.

Nope. So much nope.

In case Ambrose or anyone else has forgotten, in a liberal democracy we insist on civilian control of the military. That’s kind of a big thing, and as Stephen Saideman points out, it’s a central ingredient and necessary thing for democracy. And it’s not just this attitude creeping out in Canada, but we’re seeing it in spades in the United States right now as Donald Trump is looking to put former military members into cabinet who haven’t passed their designated “cooling off” period yet.

It’s also why I get annoyed by these stories about how the government’s plans and policies are characterised as “contradicting” the head of the Royal Canadian Airforce, for example. The problem with these kinds of headlines is that if you’ve at all paid attention to the Canadian Forces for the past number of years, you’ll see that they will always say that they have the resources at hand to do the job they’re asked to do. If the government says that 65 new planes are enough, well, then the RCAF will make sure that 65 planes are enough, no matter how much they might like or need more. Plenty of stories filtered out during the air mission in Iraq about how the RCAF was managing it despite their budget constraints, and it was a lot do to with cannibalising training budgets and so on to ensure that those missions that were being asked of them still flew, and they did it without public complaint. (Never mind that they were concerned about the declining readiness of the fleet at the time, but they still had a job to do that was being asked of them, so they made it work).

We need to remember that governments set policies, and they are held to account for the policies they set, but it’s not up to the military to tell us what that policy should be. We’ve had procurement problems in the past where the military were allowed to set their own parameters and went wild looking for the biggest and the best kit available, and boondoggles resulted. So yes, the government can set its own policies and align procurement to match it. That’s fine. And we can hold them to account for that policy on any number of metrics. But we should really refrain from that metric being “the military said the old policy was fine” because of course they were going to say that. It’s also not their job to be yet another cudgel for opposition parties to wield and then hide behind like they do with every other institution and officer of parliament. Civilian control matters. Let’s remember to treat it that way.

Roundup: Gallagher and the electoral reform garbage fire

Yesterday’s release of the electoral reform committee report was a giant headache for all sorts of reasons – the way in which the majority report was cute in their recommendations, the Gallagher Index nonsense, Monsef’s being cute in reply to the ways in which both the Conservatives and NDP were over-reading their own report, and the repeated demands that the Prime Minister respect his ill-considered promise that 2015 would be the last election under First-Past-the-Post. It was an utterly exasperating day.

While are all aware that I am team status quo because the system is not broken and any problems are not the result of the electoral system, I will offer a few observations. Number one is that the Gallagher Index is one of those devices favoured by poli sci undergrads, electoral reform nerds, and sore losers to “prove” that their preferred system is “mathematically” better than others, but it’s predicated on a couple of false notions – that in evaluating the current system that it’s a single event when it’s actually 338 separate events; and that the translation of votes to seats in this as-close-to-perfect proportion is actually desirable when it is in fact distorting the meaning of the vote itself. When we vote under our system, we are making a simple decision on who fills an individual seat, and because there are more than two candidates (and we don’t use run-off elections), it tends to rely on a plurality result rather than a simple majority. When you start demanding proportionality, you distort the meaning of that simple decision, and yes, that is actually a problem. That the report wanted a system with an Index of 5 or less, that’s not actually a simple choice of one or two systems. (If you want an explanation of the math, read this thread). Simulations of the Index under the Canadian system can itself be distortionary because of the regional nature of our elections, which why some use a “composite” Index that can produce different results from a strictly national Index figure when you try to correct for those.

The NDP/Green “supplemental report,” aside from being nigh-unreadable for all of its collection of demonstrably false talking points, recommends either an MMP system or this “Rural-Urban Proportional,” but in order to get their Index scores below 5, it means a large number of new seats particularly for MMP, while the RUP concept in and of itself is unlikely to be considered constitutional – using two separate electoral systems depending on your geography is unlikely to pass the Supreme Court of Canada smell test, but this is a decision they wanted to put on the government without that particular context. It’s all well and good to wave your hands and say you want a more proportional system, but designing one that works for Canada’s particular geography and constitutional framework is not as easy as it sounds, nor does it actually respect what you’re actually voting for. And so long as the loudest voices on this file are mired in sore loserism who figure that it’s the system that’s keeping them down and not the fact that they simply don’t have policies and candidates that can appeal more broadly, we’re going to continue to be mired in debates based on a load of utter nonsense. But hey, the government needs to make it look like they’re going to keep trying to tackle this file for another few months before they give up rather than just smothering this Rosemary’s Baby in its crib right now like they should, and just take their lumps for a foolhardy promise.

Meanwhile, The Canadian Press’ Baloney Meter™ asserts that Trudeau’s election promise was “full of baloney,” while it can credibly be pointed to the fact that they acknowledged the need for consultations which gave wiggle room.

QP: Monsef gets her elbows up

After a busy morning swallowed whole by the electoral reform committee report, it would be understandable for there to be some exasperation among all MPs. Rona Ambrose was the only major leader present, and she led off QP by demanding that the recommendation for a referendum be respected. Maryam Monsef said that she has received the report and would be reviewing it, and noted that there was no consensus and that it showed it was a huge challenge. Ambrose repeated the question in French, and this time Monsef praised the need for a values-based conversation. Ambrose hammered on the referendum issue, overplaying the strength of the referendum recommendation, and Monsef said that the committee didn’t give them an answer on the question they asked them. Ambrose claimed that it was because the PM didn’t think that people were smart enough, and Monsef said that the only recommendation of the committee was to have a referendum on the Gallagher Index. Ambrose switched to World AIDS Day for her final question and the need for stable funding. Carolyn Bennett responded that they recognised the need for stable funds, and the extended transitional funding to groups while they worked to reform the funding system. Alexandre Boulerice demanded a proportional voting system, and Monsef said that the answer of “choose your own adventure” was not an answer. When Boulerice cast aspersions on the planned national online consultation, Monsef retorted that he didn’t know the questions on it, so he was prejudging it. Nathan Cullen took over and returned to demands for proportionality, and Monsef returned to the Gallagher Index burn. Cullen groused further, and Monsef touted the new online digital engagement tool.

QP: The Goldilocks of pipelines

In the wake of yesterday’s big pipeline announcement, it remained to be seen if that would finally knock the fundraising questions off of the agenda. Rona Ambrose led off, lamenting that saying no to the Northern Gateway robbed hope and opportunity from 31 Aboriginal communities who had an equity stake in the project. Justin Trudeau noted that his government did what the previous one could not, and they would protect the environment while still growing the economy. Ambrose went or another round of the same, and Trudeau shot back that they we flailing about for something to talk about. Ambrose worried that Trudeau didn’t have a plan to deal with the Trumpocalyse (not her word) particularly with their tax plans, and Trudeau reminded her that they would engage constructively while working to diversify Canada’s trade markets. Ambrose then wondered when Trudeau would head to BC to get pipeline opponents onside, and Trudeau insisted that he was going about things the right way. Ambrose pivoted to CBC’s proposal to go ad-free for a bigger subsidy, and Trudeau replied that her party didn’t understand cultural industries and their importance. Thomas Mulcair was up next, and raised the issue of 59 First Nations opposed Kinder Morgan. Trudeau said that there were groups on all sides and that the balanced the various interests to make a decision. Mulcair switched to French to lament that the decision was done with Stephen Harper’s process, and Trudeau reminded him of their work with the provinces, particularly with new climate plans. Mulcair moved onto the appeal of a Manitoba case involving First Nations survivors, and Trudeau mouthed some platitudes about working together to move ahead in the relationship. Mulcair’s final question was on electoral reform, demanding that Trudeau keep his election promise, and Trudeau replied that he awaited the committee report and the consultations with Canadians.

Roundup: Two yays and a nay

The government announced its decisions on three pipelines yesterday – no to Northern Gateway (and a tanker ban on the north coast of BC was also reaffirmed), but yes to Kinder Morgan expansion and Line 3 to the United States. There are a lot of people not happy on either side – the Conservatives are upset that Northern Gateway also didn’t get approved, saying this was just a political decision, and the NDP and Greens (and the mayor of Vancouver) unhappy about the Kinder Morgan announcement, Elizabeth May going so far as to say that she’s willing to go to jail for protesting it.

None of this should be a surprise to anyone, as Trudeau has pretty much telegraphed these plans for weeks, if not months. And as for the critics, well, Robyn Urback makes the point that I do believe that Trudeau was going for:

In fact, Trudeau said as much yesterday in QP when he noted that they were sitting between a party demanding blanket approvals on everything, and another party opposed to approving anything, so that was where he preferred to be. He’s spending some political capital on this decision, including with some of his own caucus members who are not fans of the Kinder Morgan expansion, but he has some to spare, so we’ll see whether he’s picked up any support in the west, or lost any on the west coast when this all blows over.

QP: Pipelines and weed puns

It was Justin Trudeau’s first day back since the Francophonie and since Castro’s death, and one just knew that it was going to be everyone’s preoccupation. Rona Ambrose led off on the subject of pipelines, the big announcement coming after the markets close, and she wanted assurances that he would ensure that any approved pipelines get built. Trudeau started off by reminding the Commons that strong environmental protections were fundamental to economic growth, and that was a principle he was following. Ambrose then moved to the Castro issue, wondering what he was thinking of when praising him. Trudeau reminded her that whenever he travels, he always brings up human rights and he did in Cuba as well. Ambrose repeated the question in French, got the same again, and then moved onto the allegation that Bill Blair was hitting up marijuana lobbyists for donations. Trudeau fell back to the talking points about the rules, and when Ambrose raised that he admitted to talking up investment at his own fundraisers, Trudeau wasn’t moved, and stuck to praising the rules that were being followed. Thomas Mulcair was up next, insinuating that there was someone with canola interests at a fundraising dinner. Trudeau noted the widespread concern about the canola restrictions and his government secured market access for all farmers. Mulcair asked about the Blair fundraiser in French, Trudeau gave the rules points in French, and then Mulcair moved onto the Kinder Morgan process, calling it a betrayal. Trudeau noted the consultations they had with all sides, and that they were in the balance between a party that wants blanket approvals and another party that wants all things shut down. Mulcair went another round in French, and got the same answer.

Roundup: Peter Harder is trying to bamboozle you

Behold Senator Peter Harder, the “government representative” in the Senate. Faced with attacks from his (mostly) partisan detractors, he bravely mounted his steed, and galloped out to the webpages of Policy Options where he oh so bravely slew a straw man to defend his particular moves in modernising the Senate. And in case this wasn’t clear enough, let me spell it out for you – Peter Harder is trying to bamboozle you.

The particular straw man that Harder bravely faced was the notion that those who defend the Westminster model in the Senate are trying to keep it a mirror of the House of Lords. This, incidentally, is complete malarkey. Nobody has ever made this argument. The Senate of Canada has never borne any resemblance to the Lords (aside from the fact that each is an appointed upper body), and nobody has advanced an argument to make that claim. But Harder went on at length to prove how different the two chambers were (again, nobody claimed otherwise), and then went on to showcase all of the other upper chambers in Westminster countries and how different they were too. Look at how flexible the Westminster model is! Harder proclaims. And it’s all very “Father knows best,” as he schools everybody on parliamentary democracy. And then he starts his subtle subversion. Look at Nunavut, he suggests – they don’t have parties there! It’s a consensus legislature.

And this is the point where I want to punch someone in the throat. But I have that urge everyone someone brings up the Nunavut legislature.

The Nunavut legislature works (more or less) on a party-less consensus model because a) it has a mere 22 members; and b) it operates within the cultural context of its Inuit residents for whom consensus-making is a norm. The Nunavut legislature model is neither scalable nor portable, and anyone who tries to suggest otherwise requires a smack upside the head. The other part, which escapes Harder’s point, is that it still has an executive council and an ostensible opposition whose job it is to hold said Cabinet to account. And that’s the basis of the Westminster model that Harder quite carefully ignores in his defence of said model’s mutability. You see, the real basis of the Westminster model is that of Responsible Government, and the exercise thereof needs both a government and an opposition to hold it to account, and that can replace the government when they lose confidence. Oh, but wait – the Senate isn’t a confidence chamber, you might be saying. And that’s right. But they still have a part to play in the exercise of accountability, whether it’s asking questions of the government in their own QP (which is why the Leader of the Government is supposed to be a cabinet minister), and why they have an absolute veto, which is a necessary check on executive power.

Harder’s other suggestion – that perhaps instead of an official opposition, there instead be an “opposition representative” to mirror his role as “government representative,” is as much about undermining the ability of senators to organise opposition to the government agenda as it is about extending his own power base among the independents. 101 loose fish cannot be an effective opposition force just as much as they cannot be a consensus body (not that the Senate’s role is consensus). Harder’s attempt to delegitimise the role of partisanship in the Senate has nothing to do with trying to respect the chamber’s constitutional role (which he uses revisionist history to assert) and everything to do with his own ambitions, and he’s willing to slay as many straw men along the way as it takes to convince everyone that he’s on the right path. Don’t let him get away with it.

Roundup: The fiscal update’s hidden gem

The fall fiscal update was delivered yesterday – in the House of Commons, it must be noted – and not unsurprisingly there are deeper deficits projected while the government pledges funds to kickstart an infrastructure bank in the hopes of attracting foreign investment. Oh, and “no path back to balance” is the phrase you’re going to hear an awful lot in the coming weeks. Probably ad nauseum. Oh, and “privatization,” as the NDP now consider the infrastructure banks (because hey, we might have to start paying for the roads and bridges that this bank might fund and we couldn’t have that). That having been said, the debt-to-GDP ratio will be the government’s saving grace when it comes to the size of the deficit, as it should remain relatively stable, while still coming in at the lowest in the G7 by a significant margin. So there’s that.

This all having been said, there were other elements in the update that bear mentioning, and which should not be overlooked, which are some of the changes to the way that Parliament operates. They’re going to make the Parliamentary Budget Officer a full Officer of Parliament (which I have mixed feelings about because this solidifies his status as an unaccountable officer for MPs to fob their homework off onto while hiding behind his analyses as “objective proof” of their partisan accusation), they’re adding new independence to Statistics Canada, and they’re going to open up the Board of Internal Economy. But more important than any of that is they’re going to do something about the Estimates cycle.

Why does this matter? Because MPs are supposed to hold the government to account by controlling the public purse, but over succeeding decades, the ways in which they do that – the Estimates and supply cycle – have become so corrupted that they no longer follow the budget cycle, their accounting methods no longer match the Public Accounts so that they can’t track spending, and in many cases, MPs just vote on the Estimates in a series of votes with zero scrutiny (leaving that job up to the Senate – naturally). So if this government is promising to put the Estimates and Budget cycle back in sync, and to clean up the discrepancies between the Estimates and the Public Accounts, that is a Very Big Deal. It means that it will let MPs do their jobs like they’re supposed to do. (We’ll see if any of them do, especially with an empowered PBO for them to fob that homework off onto, but this will certainly help him too). It’s restoring some of the proper functioning of our parliamentary democracy, and we shouldn’t ignore it.

Roundup: Lamenting the regional ministries

Agriculture minister Lawrence MacAulay told his local paper that he’s not too concerned that the minister in charge of the Atlantic Canada Opportunities Agency isn’t from the region, but that he’s a Central Canadian, but hey, he’s gotten results so it’s all good. And then people went insane because how dare the government not have a regional development minister from the region, ignoring that the policy of this government has been to eschew the tradition of regional ministers writ large, and that all regional development agencies all report to the same minister – the industry minister – rather than spreading it around to a number of ministers of state (and bloating the size of cabinet while you’re at it). And then from there comes the perennial outrage that we have regional representation at the cabinet level, which ignores that cabinet positions are not actually something that requires subject matter expertise, but that it’s a political position that is largely based on managerial competence, which is fine, particularly under a system of Responsible Government that the legislature can hold them to account for the performance of their duties. After all, they have the civil service to do the subject-matter expertise part for them, and it’s the job of ministers to make decisions that they can then be held to account for. But a few of the exchanges were at least worth noting.

Most of those were all well and good, but this one from Candice Bergen caught my eye, because it actually highlights something that has largely been ignored.

While it may be a little overwrought, the point about centralizing power in the PMO is actually quite astute, and fits the pattern of centralization that Trudeau has been entirely underreported. Within the Liberal Party itself, Trudeau has convinced the party to abolish its regional powerbases and centralize it all within his own office under the guise of “modernization” and “being more responsive.” Once could very well argue that eliminating regional minister has a similar effect. That said, one could also argue that the purpose of regional minister was about pork-barrelling and doing the partisan work of securing votes from those very same regions for the government’s benefit, so their loss wouldn’t be too deeply felt in a move to make a system built to be more responsive to evidence than political consideration. Regardless, the propensity of this prime minister to consolidate power should not be underestimated, and this is something we should absolutely be keeping an eye on.

Roundup: The outsider instinct

Over in the National Post, Michael Den Tandt offers the theory that Donald Trump and his excesses have poisoned the well for other “outsider” candidates worldwide, and that his flash-over-substance style will make others take a second look. Citing the Conservative party leadership in Canada, Den Tandt supposes that this dooms a potential candidacy by Kevin O’Leary, just as Boris Johnson basically outsidered-himself out of the running to be prime minister in the UK – but I’m not sure that I buy the premise of the argument.

I think that there remains a hankering for outsider candidates despite Trump, and that that precisely because he’s poisoned the well that we’ll continue to see these kinds of players railing against the establishment. As is playing out in the Conservative leadership race here, we’ll see more candidates establish themselves as outsiders struggling against the party “elites” because that’s the narrative that has been blown wide open in recent years. (See: Kellie Leitch and Brad Trost). Den Tandt acknowledges that Tony Clement dropped out because he was unable to attract donors for being too conventional and too much an established politician, which I think is part of what blows his whole thesis out of the water. It wasn’t that Clement got in the race too soon, it’s that this notion of needing to find an “outsider” is a particularly strong influence in the zeitgeist right now, especially for conservatives who feel that the establishment has been letting them down, that it hasn’t gotten them where they need to be (witness how Harper’s incrementalism has largely been undone in a matter of months, if you don’t count the permanent fiscal chokehold that the GST cut has put into place). I think it’s why Leitch is taking the Ford Brothers/Nick Kouvalis route of yelling “gravy train,” and why Maxime Bernier is playing entirely against the rest of the party’s established policies and is getting attention for it. Everyone wants to play against the establishment and they are looking for the right way to do it. I don’t think we’ll have another Donald Trump – it would be hard to get that kind of unconstrained id and utter narcissism in a single package again – but I think there is absolutely going to be yet more people trying to find the right balance. I’m not sure it’ll be as successful in Canada as it might be in the States (particularly as our system is not really broken like theirs is), but the impulse to find that outsider is still pervasive, and it will be felt in the race here.
