Roundup: Cullen’s silver-tongued swindle

It should not surprise me, but Nathan Cullen’s capacity for deceptive stunts continues to both amaze and gall me at the same time. Previously it was conning Maryam Monsef into his “proportional” electoral reform committee composition (which was not proportional, but a racket that was designed to merely look more “fair” but was in fact a calculated gambit to give the opposition a disproportionate say in the process), for which we got a report that was a steaming pile of hot garbage. With Karina Gould now in the portfolio again, Cullen now proposes that they “co-draft” an electoral reform bill.

No, seriously.

I cannot stress how bad of an idea this is for both of their sakes. For Gould, this is Cullen trying to swindle her like he did Monsef. He played her – and the public – in trying to push proportional representation and ended up recommending (along with Elizabeth May’s whole-hearted endorsement) one of the absolute worst possible electoral systems possible. And now he’s trying to ensure that she puts it into legislation for his party’s benefit. This has nothing to do with bills being drafted secretly “backrooms” (otherwise known as the Department of Justice under the cone of Cabinet confidence) or with the spirit of bipartisanship. This is about Cullen trying to manipulate the process.

If that weren’t bad enough, what is especially galling is that he’s undermining his own role as an opposition critic in the process. He is not a minister of the Crown. His role, therefore, is not to govern, but to hold those to account who do (–William Ewart Gladstone). This is an important job because parliament depends upon accountability. That’s the whole purpose behind having a parliament – to hold government to account. And it would be great if our opposition critics would actually take that job seriously rather than pretend they were ministers with their faux-bipartisanship and private members’ bills that cross the line when it comes to acceptable bounds of setting policy. It would be great if MPs actually did their jobs. Perhaps most troublesome in all of this is that Cullen is his party’s democratic reform critic. If he can’t grasp this most basic fundamental point of Responsible Government, then can we actually trust him on attempting to find a different voting system? I’m pretty sure the answer to that is no.

Roundup: No, Monsef was not demoted

So, cabinet shuffle, and while everyone keeps saying this is somehow Trump-focused, I’m not sure what labour, status of women, or democratic institutions has to do with Trump. There will be all manner of hot takes, and yes, you’ll get mine too. It was striking in that just barely over a year into the new government, two of the most senior hands have not only been bounced from cabinet, but from parliament as a whole – John McCallum headed to China as our new ambassador, and Stéphane Dion to parts unknown in what is likely to be a diplomatic posting of some variety, but what we’re not quite sure just yet. In a government that has very few experienced hands, this is something that does give me some pause. MaryAnn Mihychuk’s ouster, however, was not a great surprise given the stuff that came out when she had a number of duties taken away from her portfolio, particularly around her attitude and her ambition to be a regional political minister in a cabinet that has largely eschewed them. Chrystia Freeland to foreign affairs is not a surprise (making her the first Liberal woman foreign affairs minister in the country’s history – previous ones had been Conservatives), Patty Hajdu to labour seems a natural next step for the job she has been doing, and François-Philippe Champagne to trade is ambitious but he proved himself as Bill Morneau’s parliamentary secretary over the past year. Another first in Cabinet is Ahmed Hussen to immigration, who is Somali-born (and while some have said he’s the first Black cabinet minister, that would actually be Lincoln Alexander).

And then there’s Maryam Monsef. She’s off to Status of Women, which people keep insisting is a demotion, but I have a hard time accepting that notion. She carried a file that is the equivalent of a flaming bag of excrement and smiled all the way through. Sure, she’s no longer the person to finish trying to smother that file as elegantly as possible (so good luck with that, Karina Gould), but a demotion would have been getting the Mihychuk treatment. Status of Women is not a demotion. People went on TV scratching their heads about what challenges are in that department, apparently having not paid attention to the big files in that department, including sorting pay equity, ensuring that all government departments actually implement gender-based analysis, and that tiny little file about the plan to combat gender-based violence. You know, no challenges at all. Plus, she’s gone from a make-work portfolio that didn’t have an actual department – just a handful of PCO staffers to support her – to an actual line-department. It’s not a demotion. And did I mention good luck to Gould because yeah, now she gets to try to stick handle trying to find a way to kill the electoral reform election promise as gracefully as possible (despite Kady O’Malley’s belief that the PM thinks that all hope is not yet lost). Because seriously – this is a file that needs to be put out of its misery before it can cause actual damage to our democratic system.

Roundup: A bit of NDP Kremlinology

On New Year’s Day, the leader of the provincial NDP in New Brunswick resigned and quit the party altogether, citing party infighting, and more curiously, took a few swipes at the federal party along the way.

Why is this interesting? Because the federal NDP are in the midst of a leadership race that will double as some soul-searching about the party’s direction. This while the leftist parties in the States saw the “success” of Bernie Sanders (and I use the term loosely but his followers are totally serious about it), and the selection and re-election of Jeremy Corbyn in the UK, where there is a definite shift in tone that follwos these leaders. And with that in mind, we saw a series of tweets from former federal NDP (and prior to that, UK Labour) staffer Lauren Dobson-Hughes which helps to put the New Brunswick and general NPD dynamic into context.

What Dobson-Hughes says here I think will have a lot of impact on the NDP leadership contest, and I think explains a little as to why the party wasn’t willing to give Thomas Mulcair another chance in his leadership review post-election. It’s also what the (eventual) leadership hopefuls will be navigating, so I don’t think this is the last of the internal power-struggles in the party that we’ve heard of. And while Cardy’s critics continue to grouse about him in the media, there are tensions at play that we should be cognisant of, and that will matter as the party goes forward.

Roundup: Senators get their funds

In case you missed the news, the new Independent Senators Group got core funding to hire staff to help coordinate independent senators’ activities and logistics. This came around the same time that they managed to strike a deal when it comes to getting more independents on committees without waiting for a prorogation to hit the reset button as the rules would otherwise dictate. Why this matters is because it allows the ISG to effectively organise their own members, to help them hire staff and do things like that – efforts which Government Leader – err, “representative” Senator Peter Harder has been attempting to bigfoot with his own offers to help these senators get staffed up and offering briefings and assisting in legislative coordination and so on. The fact that he represents the government and has been sworn into the Privy Council – regardless of his protestations that he’s independent because he’s actually not (you can’t be both an independent and represent the government – it’s like being half-pregnant) – makes this a blow to actual independence that these senators are supposed to be exercising. Giving the ISG the funds to do that on their own is an important step. Of course, the same piece mentions that Harder plans to move motions in the Senate in the spring related to his ability to restyle his title as he wishes, and that I have a problem with. This particular semantic game that he and the Trudeau government are playing around his role is a very big problem when it comes to how the chamber operates in our Westminster system, and Harder playing silly buggers with what he calls himself in order to cloak his role with the government is a problem. He and this government need to drop the charade and just come clean – Harder should be a cabinet minister in keeping with the role, and be the point of contact for accountability in the Senate. Playing games around it weakens accountability and the duty of the Senate in that role.

Meanwhile, with the appointment process for six upcoming vacancies having been announced, we also got the release of the report on the statistics from the previous round (highlights here). Maybe this time we’ll see an appointment from Southwestern Ontario, a new LGBT senator or even someone from outside of the social sciences!

Finally, Senator Denise Batters appears to have broken the rules to record a video in the Senate Chamber, accusing Trudeau of authoritarian tendencies in trying to destroy opposition in the Senate. While her basic premise – that there is a movement to shut down the position of Official Opposition in the Senate – is correct and concerning, Batters cranked it up to eleven in being completely overwrought about it, and does more harm than good to the issue. I’m not sure how much the move to weaken Official Opposition in the Senate comes from Trudeau or from Harder and his particular vision of Senate “independence” where he can co-opt the independents to his causes, but that remains a concern that I’ve heard from not only the Liberals and Conservatives in the Senate, but a couple of the independents as well. But this kind of stunt doesn’t help.

Roundup: A catalogue of ineptitude

Over in the weekend Ottawa Citizen, our good friend Kady O’Malley has a comprehensive breakdown of everything that went wrong with the electoral reform committee, and it’s pretty stunning once it’s all laid out before you. It starts with the Liberals’ relenting to allow the makeup of the committee to be more *cough* “proportional” than the traditional make-up of a parliamentary committee (which was not actually proportional, but merely gamed by the NDP to give the appearance of proportionality, and the Liberals relented for what I’m guessing was good faith). From there, it moves to the Liberals putting all newbies on the committee (with the exception of the chair) who didn’t have a clue what they were doing, and their lack of experience, combined with the fact that they no longer had a majority (despite having a parliamentary majority) meant that the opposition party gamed the witness selection in such a way that it meant they were able to self-select witnesses to get the outcome they wanted – namely 88 percent of witnesses preferring proportional systems, and furthermore, because they had motivated followings for their public consultations, it allowed them to self-select their famed 87 percent in favour of proportional systems and a further 90 percent in favour of a referendum. And almost nary was there a voice for ranked ballots. (Also a nitpick: ranked ballots have little to do with the proportionality that people keep trying to force the system into, nor are they about gaming the system in favour of centrist parties like the Liberals. Rather, ranked ballots are designed to eliminate strategic voting, ensure that there is a “clear winner” with a simple majority once you redistribute votes, and to make campaigning “nicer” because you are also looking for second-place votes. Experience from Australia shows that it has not favoured centrist governments).

In other words, this whole exercise was flawed from the start, in large part because the Liberal government was so inept at handling it. In fact, this cannot be understated, and they are continuing to be completely inept at handling the fallout of the broken process that they allowed themselves to be bullied into (lest they face charges of trying to game the system – thus allowing the other parties to game it for them), and rather than either admitting that this went off the rails (because it did) and that it was a stupid promise to have made in the first place (because it was) and trying to either be honest about cutting their losses, they’re dragging it out in order to find a more legitimate way to either punt this into the future, or declare that no consensus can be found (which there won’t be) and trying to kill it that way. But in the meantime, the daily howls out outrage of the opposition because of the way that they have completely bungled not only the committee response (and let’s face it – the report’s recommendations were hot garbage) and the further rollout of their MyDemocracy survey without adequately explaining it has meant that this continues to turn into an outrageous farce. I’m not necessarily going to lay this all at the feet of the minister, or call for her resignation, but this is one particular file where the government has been so clueless and amateurish that the need to pull out of the tailspin that they find themselves in, take their lumps, and then smother this in the crib. Enough is enough.

Roundup: Trying to help with attendance

The Conservatives have become very preoccupied with Justin Trudeau’s attendance in Question Period of late, which is one of those particular political cudgels that annoys me on a couple of different levels. On the one hand, I’m annoyed at the PM for not taking it more seriously and showing up in order to be held to account, as our system of government demands; on the other hand, I get annoyed when the opposition plays cheap politics with this because they are just as guilty, with their own leaders having fairly poor attendance records to match. It’s especially precious that the Conservatives are so concerned about Trudeau’s attendance as Stephen Harper’s was abysmal, and by 2014, you were lucky if he might show up once a week. Might.

Huffington Post crunched the numbers and found that Trudeau has missed 58 percent of QPs within his first year, while Stephen Harper missed 46 percent in his first year. Mind you, that was his first year, and that thrice-weekly attendance fell off pretty quickly. Trudeau has had a fairly punishing international schedule, which is part of his job – but we’re seeing a number of instances, especially lately, where he is in town and not attending, or that he counter-programmes another event to take place at the same time as QP, which again annoys me because it shows that he’s not taking the responsibility of being held to account seriously. Sure, it’s great that you want to show kids that that coding is a good life lesson, but there are other hours in the day where that might be more appropriate, and not when you should be answering questions for your government’s actions.

But the petty politics that the opposition are playing around this are frustrating. Offering to move Question Period to 4:15 in the afternoon – or any other time to “help” the PM make it – is lunacy considering how disruptive it leaves the rhythms of operation on the Hill, with committee schedules where witnesses have flown in across the country, with the media’s ability to keep the production cycle of news shows. I’m not saying that this is a big deal, but I’m not sure that this is the way to address the problem of non-attendance, particularly when other leaders can hardly deign to make their own appearance most days.

Roundup: Nine new senators

Nine new senators were appointed yesterday, with another 12 appointments to come in the next few days. By the time that happens, the non-aligned senators will have the plurality in the chamber, but that is causing a bit of consternation among some of the existing independent senators. Senator André Pratte sent out a missive decrying that committee seats are not proportional yet, while Senator Claude Caignan groused about the appointment process as being neither open, transparent, nor non-partisan, and insinuated that they were all Liberals in all-but-name and intimated that they would all be “steadfastly loyal” to the Prime Minister for appointing them – you know, just like he was unthinkingly partisan and loyal to Harper since his own appointment.

As for some of the new senators, PowerPlay interviewed incoming senator Patricia Bovey and the chair of the appointments committee, Hughette Labelle, while Power & Politics interviewed Diane Griffin. The Canadian Press profiled Daniel Christmas, who will be the first Mi’kmaq senator.

P&P went hard on the fact that some of these new senators had previously donated to parties – and not all of them to the Liberals – which is irksome because it’s giving this message of a rather unfair level of non-partisanship being expected when donations are part of political engagement in our system, and we should want senators who have at least had some level of engagement and were not completely disinterested in politics. As for the pace at which the modernization to the Senate rules are happening, I would caution against moving too quickly – as Pratte is demanding, Senator Peter Harder is glowering darkly about, and Terry Milewski was being ridiculous in his characterisation of on P&P. If we want an upper chamber that is functional but not dominated by parties, we want to make sure that rule changes are done right and not in haste, and we especially don’t want them to be turning over any swaths of power to Harder as the “government representative,” as he is already empire-building and starting to try and co-opt the non-aligned senators as they organise themselves. If they’re not getting on committees fast enough, that’s in part because the rules are such that committees can’t be reconstituted until a prorogation, but we also want to give these new senators time to get adjusted and settled. Throwing them onto committees too soon will be overwhelming, and if they’re interested, they can still sit in on the committee meetings and contribute – they just can’t vote. The proportions of seats will adjust before too long. A little patience is not a bad thing.

Roundup: Lamenting the regional ministries

Agriculture minister Lawrence MacAulay told his local paper that he’s not too concerned that the minister in charge of the Atlantic Canada Opportunities Agency isn’t from the region, but that he’s a Central Canadian, but hey, he’s gotten results so it’s all good. And then people went insane because how dare the government not have a regional development minister from the region, ignoring that the policy of this government has been to eschew the tradition of regional ministers writ large, and that all regional development agencies all report to the same minister – the industry minister – rather than spreading it around to a number of ministers of state (and bloating the size of cabinet while you’re at it). And then from there comes the perennial outrage that we have regional representation at the cabinet level, which ignores that cabinet positions are not actually something that requires subject matter expertise, but that it’s a political position that is largely based on managerial competence, which is fine, particularly under a system of Responsible Government that the legislature can hold them to account for the performance of their duties. After all, they have the civil service to do the subject-matter expertise part for them, and it’s the job of ministers to make decisions that they can then be held to account for. But a few of the exchanges were at least worth noting.

Most of those were all well and good, but this one from Candice Bergen caught my eye, because it actually highlights something that has largely been ignored.

While it may be a little overwrought, the point about centralizing power in the PMO is actually quite astute, and fits the pattern of centralization that Trudeau has been entirely underreported. Within the Liberal Party itself, Trudeau has convinced the party to abolish its regional powerbases and centralize it all within his own office under the guise of “modernization” and “being more responsive.” Once could very well argue that eliminating regional minister has a similar effect. That said, one could also argue that the purpose of regional minister was about pork-barrelling and doing the partisan work of securing votes from those very same regions for the government’s benefit, so their loss wouldn’t be too deeply felt in a move to make a system built to be more responsive to evidence than political consideration. Regardless, the propensity of this prime minister to consolidate power should not be underestimated, and this is something we should absolutely be keeping an eye on.

Roundup: Poisoning the expenses well

With the story out yesterday morning about Rona Ambrose’s expenses claimed while staying in Stornoway, I think we’re starting to approach peak ridiculousness with the growing war over expenses, and accusations of poor judgment across the board. That the Conservatives have spent the past two days pushing a non-story about Dominic LeBlanc giving a speech at an event sponsored by a law firm with Irving connections, claiming poor judgment and a conflict of interest where clearly none actually exists (it’s not a fundraiser, no decisions are being made, it’s a speech, FFS), it’s desperation and grasping at straws.

The bigger problem, however, is the corrosive effect this continues to have, fuelling not only the cheap, petty outrage that voters are being encouraged to feel anytime government spends money, but it is starting to burn the very real bridges for why we have expense regimes in the first place.

Like Rob Silver above, Wherry may be exhibiting his trademark sarcasm, he’s got a point – we are rapidly approaching the point where We The Media have stoked such public opposition to legitimate expense claims by clutching our pearls at seemingly large numbers presented without context while crying “Judgment!” and “Taxpayers’ money!” that people are developing the wrong impression. We had NDP MPs last parliament declaring that if we’re to have senators, then they should all work as volunteers, and lately I’ve had jackasses barking at me on the Twitter Machine saying that senior political staff should also be volunteers. We’re half-a-step away from people demanding it of MPs.

Which gets back to the whole point of expense regimes in the first place – so that it acts as an equaliser, so that you don’t have to be inordinately wealthy in the first place in order to participate in political life, be it as an MP or senator (or senior political staffer, apparently). Do we really think it’s for the best that we return to an era where only the wealthy can afford to participate in political life and let them dictate policy for us? Or where a lack of an expense regime would encourage actual graft (as opposed to this nonsense we’re currently getting the vapours over with moving expenses and whatnot) from politicians to help make themselves financially whole from the expense of doing their jobs? Seriously, we need to grow up and stop poisoning the well because we don’t want to go where this road leads. Only certain doom lies that way.

Roundup: Harder’s arrogant dismissal

It is probably not without a certain amount of chutzpah that Senator Peter Harder went before the Senate’s modernisation committee yesterday, and not only lectured to them about what the Senate does, but offered his particular thoughts on how the institution should be reformed, and most of all, having the gall to suggest that there was nothing that could be learned from the House of Lords and their integration of crossbenchers. Harder, with his mere couple of months of experience, has taken it upon himself to declare that the Senate should comprise of the government representative (a creature which does not actually appear in convention, statute or logic) and independents who will loosely affiliate on an ad hoc basis – no government, no opposition, no parties, no partisanship.

Give. Me. A. Break.

This declared allergy to partisanship in the upper chamber has reached the point of being utterly ridiculous. Parties exist for a reason. No one is arguing that the current power structure in the Senate needs to be broken apart and for independents to be given more power and resources, but blowing up parties is not the way to go, nor is assiduously screening nominees for any past hint of partisanship because there is nothing inherently wrong with partisanship. If Harder thinks that 105 individuals can sufficiently organise themselves for debates without any kind of structure – that his office doesn’t impose anyway – is lunacy. And it does concern me that Harder is making a bit of a power grab, especially considering that his office is already poised to start offering staffing services for the incoming batch of senators, which is not only unseemly but once again looks to bigfoot the work that the Independent Senators Group has been doing to come up with a bottom-up approach to organising unaligned senators in a manner consistent with the operation of the Chamber while working to give them caucus-like powers for committee assignments and with any luck, research dollars and support. But this isn’t the first time that Harder has attempted to bigfoot this nascent group, and I think that’s a very real problem. His attitude towards the modernisation committee – and in particular his arrogant dismissal of the crossbencher model (which the Independent Senate Group has been looking toward) – is a worrying sign.

Meanwhile, Andrew Coyne not only unhelpfully endorses the Segal-Kirby call for the Senate to limit its veto to a suspensive one (because hey, it’s not like we might need an option to stop a prime minister with a majority from passing really terrible legislation), but goes one step further and proposes that any bill in the Senate that has not been passed in six months is deemed to have passed, so that when they can’t procedurally speed through certain bills that get bottlenecked in committees (like any private member’s bill, many of which are objectively terrible), or when they demand more time and attention, they should just be passed anyway? Seriously? What a way to run a parliament.
