QP: Demanding adult supervision

Despite the fact that it was a Monday, none of the leaders save Elizabeth May were present in the Commons. Denis Lebel led off, blaming Chrystia Freeland for being unable to conclude the Canada-EU trade agreement, or any other trade agreement. Freeland insisted that Canada had done its job, but this was an internal dispute for the EU to resolve and then come back to Canada, and that she remained committed to it. Lebel repeated the question in English word-for-word, and Freeland elaborated on her answer. Lebel demanded that the PM head to Europe to salvage the deal — as though that was how negotiations work, and Freeland started getting feistier about the previous government’s record. Gerry Ritz picked up the torch, and took on a more bullying tone with a pair of questions that belittled Freeland for her visible emotion in Brussels, and saying that she needed the “adult supervision” of the Prime Minister. Freeland had none of it, and hit back on the previous government’s record on the stalled agreement and expensive signing ceremonies for a deal that wasn’t done. Murray Rankin led off for the NDP, and kept up the same topic, but from the angle that they needed to drop the investor-state dispute resolution mechanism. Freeland listed socialist governments in Europe who had signed onto the deal, trying to prove it’s not just an ideological divide. Niki Ashton then got up to decry the comments from the Finance Minister about “job churn,” decrying precarious work. MaryAnn Mihychuk said that the new work environment had a lot to do with technology but they were helping Canadians. Ashton demanded that Morneau and the PM attend their precarious job summit, to which Mihychuk reminded her that they have a youth workers council.

Roundup: Fundraising fears

It’s been a curious thing the last few days, watching in QP as the Conservatives are tearing their hair out over this Bill Morneau fundraiser in Halifax and raising the spectre of the wealthy contributing to politics, and calling Bill Morneau a millionaire like it’s a bad thing. As though suddenly the Conservative Party of Canada has become overrun by socialists or something. Really, it’s just their cheap populism run amok, trying to cast themselves as champions of ordinary Canadians (never mind that their policies disproportionately aided wealthier Canadians during their decade in power), and if they really were the champions of the working class, you would think the rest of their policies to date would be different (such as around labour unions or the Canada Pension Plan, or anything like that), but no. And if you think this is really a question about ethics or conflicts of interest, well, no, the Ethics Commissioner herself has stated that this fundraiser was above board, but hey, if they wanted to tighten the rules around fundraising, she’s been asking them to do that for years and after a decade in power, they wouldn’t do that either. So here we are, with a desperate attempt to frame perfectly above-board fundraising as “cash for access” and somehow comparable to the situation in Ontario, which it’s not. QP: A scrappy anniversary

At long last, all leaders were in the Commons, and Rona Ambrose led off by immediately demanding that the PM stop meeting with billionaires and restoring those boutique tax cuts that the government got rid of. Justin Trudeau reminded her of the tax cuts they made across the board to the middle class. Ambrose worried that the new mortgage housing rules hurting families. Trudeau replied that he was bringing investment into the country and listed the companies that have been moving more operations to Canada. Ambrose went another round in French, and Trudeau listed the ways in which they’ve helped families. Ambrose moved onto the issue of the healthcare accord, decrying waitlists. Trudeau said that Canadians expect healthcare dollars to be spent on healthcare. Ambrose then moved onto the “carbon fuel tax” impacting Alberta, but Trudeau hit back that the last government couldn’t get Alberta’s resources to markets after a decade in power. Thomas Mulcair was up next, decrying a Bill Morneau fundraising event in Halifax which he called “cash for access.” Trudeau insisted that the rules were already the most stringent and they followed them. Mulcair moved onto healthcare funding and the lack of an accord with the provinces, and Trudeau reiterated his previous answer about ensuring dollars are properly spent. Mulcair then moved onto a pair of questions on electoral reform and demanded a proportional system. Trudeau recalled when Mulcair was afraid the Liberals would ram though a new system, and that it was curious that Mulcair was demanding they do just that.

Roundup: A new Supreme Court appointment

The government announced their new pick for the Supreme Court of Canada, and lo and behold, it’s Justice Malcolm Rowe of the Newfoundland & Labrador Court of Appeal. It’s a little unexpected considering what they were signalling in terms of looking for more diversity on the bench, but they managed to find a bilingual justice in Newfoundland & Labrador, and they get to pat themselves on the back for making the first appointment to the top court from that province, so they’ve made history! Also, they’ve respected the constitutional convention around the regional composition of the court, and for that, the Conservatives have declared victory – because it was totally their non-binding supply day motion that forced the government’s hand! (Also, appointment panel head Kim Campbell seemed pleased that this was the choice from the short list that they submitted).

So Atlantic Canada is happy, and the government is making a big deal out of its new process including transparency by publishing the application form that Rowe submitted with his answers to a number of questions around his thoughts on significant decisions that he has been a part of, and his thoughts on the role of the judiciary in the legal system, which is unprecedented. As well, next week both the justice minister and Campbell will face a parliamentary committee to explain their choice (thus preserving the committee role of holding cabinet to account), to be followed by a Q&A session with Rowe to be led by a law professor with both MPs and Senators asking the questions. So transparency without devolving into an American-style “confirmation” process. At this rate, Rowe should be on the top court by early November, which means he’ll have missed about half of the fall session of the court (which isn’t as bad as the vacancy issue caused by the Nadon appointment where the court sat 8 in a number of cases). Of course, Rowe’s answers are already provoking some criticism, though it’s not necessarily shared by all members of the legal community. So what of the signals the government was sending that they wanted an Indigenous judge, preferably a woman? Well I do think reality did set in when they faced pressure from their Atlantic caucus and the premiers to ensure that the seat remained an Atlantic one. It may well have been them floating a trial balloon about abandoning the convention, but it may also have been a warning. There are two more seats opening up in the next few years (barring deaths or retirements), being Chief Justice Beverley McLachlin (a Western seat) and Justice Rosalie Abella (an Ontario seat), and in both of those cases, the government is saying to the legal community that there had damn well better be some more diverse, bilingual candidates ready to fill those seats when the time comes – something that was more difficult to find in Atlantic Canada owing to their demographics. We’ll see in the next few years, of course, but I think the warning has been delivered.

QP: Tributes for Prentice

Half of the leaders were present in the Commons today, and after some tributes for the late Jim Prentice from all parties and a moment of silence, QP got underway. Rona Ambrose, mini-lectern on desk, asked about the size of the deficit, which is more than had been promised. After a quick rebuke about making investments, Justin Trudeau gave a tribute to Prentice of his own. Ambrose was concerned that jobs were not being created and demanded that he stop spending and focus on jobs instead. Trudeau noted that the Conservative approach didn’t create growth, while he was cutting taxes for the middle class. Ambrose then mischaracterized a whole list of things as taxes before decrying the possibility of a Netflix tax. Trudeau repeated his response about cutting taxes on the middle class. Denis Lebel was up next, decrying the lack of a softwood lumber agreement and how it was hurting families. Trudeau responded with the list of ways they are helping families. Lebel doubled down on the softwood lumber agreement, and Trudeau agreed that they were concerned about the file, but the former government’s broken relationship with the Americans didn’t help. Peter Julian led off for the NDP, demanding money for home care while mischaracterizing the changes to health care escalators. Trudeau reminded him that the Harper approach to healthcare was to write a check and not ensure that the money was spent on healthcare. Julian demanded that the health transfer escalator remain at six percent for another year, but Trudeau was not responsive to his logic. Brigitte Sansoucy repeated both questions again in French, and got much the same response from Trudeau in French.

Roundup: A vote for support

We have the motion on the Order Paper now for the debate and eventual vote on the newly refocused mission in Syria and Iraq, and to the relief of those of us who care about things like Crown Prerogative and the powers of the executive, it’s crafted simply in the language of supporting the mission. This is critical, because asking for authorisation is a giant can of worms that nobody really should want to even contemplate opening, but even with this language, it’s going to cause headaches going forward. To recap, asking for authorization is something that launders the prerogative and thus the government’s accountability. When something goes wrong, they can shrug and say “the House voted for the mission,” and to varying degrees, the Harper government did this, particularly with relationship to Afghanistan. These non-binding votes are a rather unseemly bit of political theatre that purports to put the question to MPs – because apparently they need to have buy-in when we send our men and women in uniform into danger, or some such nonsense – and it gives parties like the NDP a chance to thump their chests about peacekeeping and pandering to pacifistic notions (and does anyone seriously buy that nobody is trying to stop the flow of money, arms and fighters to ISIS without Canada butting to the front of the line to finger-wag at them?), and parties like the Conservatives a chance to rail that they were doing so much more when they were in charge (when they weren’t), or when they were in charge, to pat themselves on the back for everything they were doing (when really, it tended to be a bare minimum at best, or a symbolic contribution at worst). Of course, all of this could be done with a simple take-note debate without a vote, which is how it should be, because a vote implies authorisation, and that’s how the NDP have read each and every vote in the past, and they will loudly remind everyone in QP and elsewhere about it. Trudeau has been trying to keep expectations measured by saying that they recognise the role of the executive in making these decisions – but he went and proposed a vote anyway, muddling the role of MPs in this situations like these. That role, to remind you, is to hold the government to account, so if you’re going to have a vote on a military mission, then one might as well make it a confidence vote because foreign policy and control of the military is at the heart of the Crown’s powers. (These authorisation votes that aren’t confidence measures are playing out in the UK right now, which is making a mess of their own system, for the record). Trudeau should have known better than to continue this pattern of confusion and left it at a take-note debate, like it should be. A vote, whether it’s an actual authorisation or just a declaration of support, only serves to make the waters murky, which we need our governments to stop doing before they do lasting harm to our system of Responsible Government.

Roundup: Making the AFN pitch

The Assembly of First Nations has been holding their General Assembly in Montreal, and both of the two main opposition leaders addressed them yesterday. As First Nations leaders try to convince their people to start flexing their political muscles, with some 51 ridings they say that they can influence, both Thomas Mulcair and Justin Trudeau made their pitches to the assembled chiefs. For Mulcair, it was largely a recapping of pledges he had made previously, while Trudeau unveiled a much more comprehensive policy plank for the party’s election platform. The fact that the parties are making this kind of a pitch – probably the most high-profile of such pitches in recent electoral memory – is a sign to the seriousness to which Canadians are taking these issues now, where they would have been considered far more niche in elections past.

QP: He was talking about Greece

Thursday, and wouldn’t you know it, and to my great surprise, Stephen Harper was actually present for a change. Neither Thomas Mulcair nor Justin Trudeau were present to face off against him, however, so make of that what you will. That left Peter Julian to lead off, and wouldn’t you know it, he started off with yet another Mike Duffy question, on the altered audit report. Harper, of course, rejected the premise of the question and noted that Duffy was before the court for his own actions. Julian moved to the pro forma question about Duffy’s residency, and Harper responded with a pro forma response about the NDP satellite offices. Julian moved onto the Senate invoking privilege to keep their internal audit from the court — not actually government business — and Harper responded again with the satellite offices. Niki Ashton was up next, and asked about the lack of response to the First Nations housing fund, and Bernard Valcourt read a statement about significant resources being allocated to meeting housing needs. A second round was much the same. Scott Brison led off for the Liberals, asking about relaxing labour laws that would make it easier to fire Canadians, which Joe Oliver supported. Harper insisted that Oliver was talking about Greece, not Canada, and slammed the Liberal record. Brison pushed on the issue, and Harper read the latest Conservative attack line about how Trudeau apparently wants a new mandatory payroll tax. Marc Garneau closed the round, asking about the same issue in French, and got the same answer about it being a discussion about Greece, and that the Liberals would raise payroll taxes.

QP: Consistently improving the lives of veterans

Despite it being Thursday, none of the major leaders were in the Commons to carry on the great exercise of accountability. Stephen Harper made an announcement in Markham, Thomas Mulcair was preparing to jet off to Paris for the weekend, while Justin Trudeau was in St. John’s. That left Peter Julian to lead off, asking about the personnel cuts at Veterans Affairs. In response, Julian Fantino robotically praised the new operational stress injury clinics that they were opening. Julian read off more questions about cuts to veterans services, but Fantino stayed true to his programming, and praised the government’s commitments to veterans. Jean Crowder then asked a pair of questions about a First Nation who was taking the government to court over Site C, to which Colin Carrie insisted that they had extensive consultations and that the generation project would generate the fewest GHGs. Marc Garneau led off for the Liberals, asking about the recycled funds being used for veterans research, and added the call for Fantino’s resignation. Fantino insisted that the opposition let veterans down by voting against them. Joyce Murray asked about a veteran fighting the government for his pension, to which Fantino accused the Liberals of being responsible for the problems in the system today. Frank Valeriote closed the round asking about court cases against the department, to which Fantino said he wouldn’t comment, but then slammed the Liberals for voting against veterans.

Roundup: Conservative senators see looming crisis

Wouldn’t you know it, but Conservative senators are pressuring Stephen Harper to start making some new Senate appointments as the current number of vacancies is at eleven, and will be at 17 by the end of the year – almost a fifth of the Chamber. The lack of membership means committees are starting to be affected, and provinces are losing a good portion of their representation, which is a problem. And despite what Hugh Segal says, the Prime Minister actually does have a constitutional obligation to make appointments, and if he doesn’t, he risks triggering a constitutional crisis because he would be in breach of his duties. He certainly has options when it comes to how he makes appointments, especially because of the cloud he’s put himself under by making irresponsible choices in the past (because he was petulant and refused to make appointments until his hand was forced, it should be said), but they need to be made, sooner than later. I did hear from some sources that with the Supreme Court appointment issue out of the way, he could spend the summer making Senate appointments, but I guess we’ll see if that bears fruit.
