QP: Concern about summer vacations

The day was not as hot as yesterday, but tempers were indeed starting to fray in the House of Commons with the threat of procedural shenanigans hanging in the air. Andrew Scheer led off, saying that the PM was eager to get away for summer vacation but lo, there were all kinds of new taxes. Trudeau noted that his summer vacation plans included touring the various federal parks around the country, which were all free, and oh, he lowered taxes on the middle class. Scheer then switched to French to demand a publicly accessible sex offender registry, to which Trudeau noted the existing system worked just fine. Scheer tried again in English, and got the same answer. Scheer turned to the Norsat sale in French, and Trudeau assured him that they listened to their national security agencies and allies. They went another round of the same in English, before Thomas Mulcair got up to ask the same question in English. Trudeau reiterated his response, and Mulcair insisted the answer was “demonstrably false.” Mulcair hammered away in French, but Trudeau stuck to his points about due diligence. Mulcair then demanded the government adopt the NDP’s proposed nomination process for officers of parliament, but Trudeau insisted that they already adopted a new process that got more meritorious diverse appointments. Mulcair tried again in French, but got the same response.

Roundup: Imagining something we already have

Two different reality shows have been made pitches about televising the renovations to 24 Sussex, and some of their reasons for doing so are frankly appalling. On the one hand, one can see the temptation of such a project, both in terms of the drama, the fact that the constant conversation and hate-watching would drive the ratings, or the possibility of some form of public accountability where people would see on their screen what their millions of dollars of tax dollars are paying for (and before you say anything else, I am very dubious about that  $38 million figure being thrown around, because it likely involves a bunch of security bells and whistles that the RCMP have thrown into it that may not actually be necessary but are a bunch of “nice to haves” while they’re blue-skying). And while that’s all well and good, one of the proponents, Lynda Reeves went and put her foot in it.

We already have our “White House equivalent,” and that’s Rideau Hall. It’s where the Head of State resides when she’s in the country, and where her representative lives and conducts his work. And I know that this may be hard for someone like Reeves to grasp, but the prime minister is not a president. He is the head of government, the “first among equals” of the Cabinet, and most emphatically not the head of state. He may have an official residence, but he doesn’t require the equivalent of a White House because his job is not the same, and he has two official offices – one in Langevin Block, and the other in Centre Block (with a temporary replacement being constructed in the West Block as we speak for the decade where the Centre Block will be out of commission). He doesn’t need a live-work space like the White House is.

It’s this kind of intellectual and cultural laziness that is the exact same as people who refer to Sophie Gregoire Trudeau as the “First Lady” when she very much is not. We don’t have a First Lady or a First Family because we have a monarchy, and those roles belong to the Royal Family. The closest thing we have to a “First Lady” other than the Queen (or Prince Philip if you want to qualify the spouse of the Head of State in such a role) is actually the Chatelaine of Rideau Hall, which is the title given to the spouse of the Governor General when the spouse is a woman (which I suppose would be châtelain when the GG is a woman with a male spouse).

So no, Lynda Reeves, we don’t need a symbol similar to the American White House because we already have one. And if we want Canadians to have an image in mind when they close their eyes and imagine what the equivalent is, there are plenty of photos to choose from. Here’s one:

Roundup: Wrongheaded notions about party policy-making

Over at Policy Options yesterday, Stephen Harper’s former policy director, Rachel Curren, lamented the policy-making process of the Conservative Party, sighing about the fact that the majority of the leadership candidates were just retreads of Harper-era policies. But sweet Rhea mother of Zeus was her op-ed full of so many mistruths about the Westminster parliamentary system, that my head about exploded.

While Curran was disingenuous about how the Conservatives were the party of grassroots policy-making that the Liberals were top-down (that has not been the case until they changed their policy process just last year, which is a problem), the crux of her article rested on this notion that the party needed some outside policy groups or think-tanks to do the heavy policy lifting for them because they were just too cautious a group to do it otherwise.

The notion that it’s not the role of the party itself to engage in policy development, but rather to fight and win elections, is complete and utter bullshit. Likewise, it’s not up to the civil service to come up with policy either – they can offer advice and options for implementation, but political policy is certainly not their job.

It is absolutely the role of the grassroots to engage in policy development because that’s their job. Politics is supposed to be about bottom-up engagement, both in terms of policy development and in the selection of candidates (and removal of incumbents when necessary). And what utterly boggles my mind is the notion that Curran is peddling that we should take away what little power the grassroots has left and pass it off to these third-party think-tanks that can access the kind of funding that parties can’t, and have little accountability. If we take this away from the grassroots, then what good are they? Continuing the farce of our illegitimate leadership selection process to coronate unaccountable presidential figures who can then dictate top-down policy and control over the party (and if you don’t think they’re not dictating policy, then why the hell are they running on it in this gong show of a leadership contest)? These contests actively disenfranchise the grassroots (despite all appearance to the contrary), so taking away what policy powers they have left leaves the grassroots with what? Being donors with no say in what they’re donating to? How is that any way to run our political system?

This kind of stuff infuriates me because it’s not the way politics is supposed to happen. The grassroots are supposed to be empowered, and leaders are supposed to be responsive to them – not the other way around like it is now. It’s a problem and it’s one we need to fix, and hey, I just happened to have written a book all about these kinds of issues, which I would suggest that Curran read, because she might learn a thing or two.

Roundup: The Meilleur problem

The feigned outrage over Madeleine Meilleur’s nomination as the new Official Languages Commissioner, combined with the disingenuous concern over the search for a new Conflict of Interest and Ethics Commissioner, is really starting to annoy me – particularly because of the way in which things are being spun, and the abject hypocrisy of it all. As for Meilleur’s surprise that this has become an Issue amidst a snake nest of partisans looking to stir things up and try and throw as much mud on the PM as they can, I have to say Oh, come on. You were in Queen’s Park. You know that they’ll play politics over this. Because seriously.

To start with, I will take note of Meilleur telling an interviewer that she had initially thought about applying to be a Senator to continue to contribute to public life now that she had resigned from Queen’s Park. While I continue to object to the self-identification process that this government has put into place (because why not try to get every narcissist in the country to hand in a CV?), the fact that she was told by the head of the selection committee that recent politicians were verboten in the “newly independent” Chamber is kind of infuriating. Why? Because the Senate is Parliament’s institutional memory. It’s a Good Thing to have some experienced political players in there, from both federal and provincial sides, so that they can be of use to Parliament as that institutional memory. That Trudeau seems keen to destroy that function of it is a problem.

As for Meilleur meeting with Gerald Butts and Katie Telford, I’m far less sold that this is somehow suspicious partisan work. They are contacts she had from their mutual time at Queen’s Park, and she was looking for ways to contribute, and hey, they’re people who would have some ideas. You realise that trying to make a Thing out of it is childish, right? Is the fact that she was once a provincial Liberal a problem for the job? Perhaps, if she didn’t have the qualifications for it. But by all accounts, she is more than qualified, which makes the partisan gamesmanship all the pettier. And to hear the party that appointed Vic Toews to the Manitoba Court of Queen’s Bench rail on about how terrible this is, I have little patience for their arguments.

Meanwhile, as for the Conservatives’ demands that the process for the new Ethics Commissioner be turned over to a third party, I have a couple of things to say: one is that this is a democracy and not a technocracy, so stop trying to offload political decisions to outsiders; two is that you get to hold the government to account for the choices that are made; and three, demanding a retired judge make the selection, when the criteria specifies that the new Commissioner should be a former judge or head of a tribunal, you’re just creating a new conflict of interest because you’re asking said judge to appoint a former colleague. How is this any better? Seriously, do you people not stop to think for one second about your supposed attempts at being clever? Honest to gods, you people.

QP: Bell Island conspiracies

With Justin Trudeau on his way to the Microsoft conference in Washington State, and Rona Ambrose bowing out, there were only two leaders present for QP today. Candice Bergen led off, railing about the PM’s Xmas vacation — again — using the reach of a story about the island’s ownership to raise doubts. Bardish Chagger gave the usual reply. Bergen used this as a hook for a question to accuse Chagger of being the wrong person to be in charge of finding a new Ethics Commissioner, and Chagger reminded her that the process is open and anyone can apply. Bergen insisted that the government was simply looking for Liberal donors, citing Madeleine Meilleur’s nomination as Official Languages Commissioner. Diane Lebouthillier took this one, praising Meilleur’s record. Gérard Deltell was up next, worrying about the Infrastructure Bank and the search for a board despite the fact that it had not been created yet. Amarjeet Sohi reminded him of the value of the Bank, and that they wanted to gave board members ready to be appointed when the Bank’s creation was authorised by Parliament. On a second go from Deltell, François-Philippe Champagne took the opportunity to tout the Invest in Canada Agency that they were also looking for appointees for. Thomas Mulcair was up next, spinning a conspiracy about the tentacles of KPMG infiltrating everywhere, and Lebouthillier got up to note all of the measures they were taking to combat tax evasion. Mulcair asked again in French, and got the same answer. Mulcair then took a swipe at Meilleur’s appointment at Languages Commissioner, and Lebouthillier repeated her lines about Meilleur’s record. Mulcair demanded that Chagger recuse herself from the selection of the Ethics Commissioner, and Chagger reminded him of the open process.

QP: Rona Ambrose’s swan song

With the news that Rona Ambrose was stepping down now confirmed, and Justin Trudeau present for what was likely the only day this week, QP was off and running. Ambrose led off, asking about the report calling to scrap and replace the National Energy Board. Trudeau noted that they have been consulting, and reiterated that they are serious about ensuring that the economy and the environment go together. Ambrose took exception to the report recommendation that its headquarters be moved to Ottawa from Calgary, and Trudeau took a few shots at the previous government politicising the Board while he was working to restore trust in the process. Ambrose worried that Trudeau was trying to choke out the oilsands in red tape, but Trudeau insisted that a responsible approach would mean growing the economy. Ambrose switched to French to demand that the House appoint a new Ethics Commissioner without any Liberal interference. Trudeau jabbed back about political appointments the Conservatives made while touting his own merit-based process. Ambrose noted that the last question would likely be her final one as leader of the opposition, and said she would call off her attack dogs if he answered how many times he met with the Ethics Commissioner. Trudeau reminded her that she asks them not to talk about investigations and he has met with her several times over his time as an MP, and was going to pay Ambrose a compliment before he was drowned out. Thomas Mulcair was up next, raising the reach of a CBC news story about the ownership of the Aga Khan’s island. Trudeau retreated to the talking point that it was a private family vacation. Mulcair railed about the helicopter ride, but Trudeau noted that he would answer any questions the Ethics Commissioner may have. Mulcair then moved onto the story about someone from KPMG working for the Liberal Party, in the context of a committee study of the firm being voted down, and Trudeau noted that the committee is independent. Mulcair pressed, and Trudeau launched into a spiel about ethics and openness.

Roundup: The curious PCO-PBO turf war

There is an interesting piece out from Kathryn May on iPolitics about the turf war going on between the Privy Council Office and the Parliamentary Budget Officer, and how that is playing out in the provisions of the budget implementation bill that would create an independent PBO. The PBO blames senior bureaucrats for trying to hobble its future role, and much of it seems to be down to an existential difference of opinion, between whether or not the PBO should exist to give advice to parliamentarians, or to be a watchdog of the government. PCO takes the view that the PBO was designed to offer advice and independent analysis, while the first PBO, Kevin Page, was certainly taking the latter view, which his successor has largely followed suit with. One of the other interesting notes was that the public service would rather the PBO act in more of a fashion like the Auditor General, where he goes back to departments with his figures to check for factual errors, and that it gives them a chance to respond to the report, rather than feeling like they are being constantly “ambushed.”

I am of the view that we run the risk of creating bigger problems if we continue to give the PBO too broad of a mandate, while being unaccountable and only able to be terminated for cause, meaning seven year terms by which they can self-initiate all manner of investigations with no constraints. That will be a problem, given that we already have at least one Independent Officer of Parliament who is going about making problematic declarations and giving reports of dubious quality without anyone calling him to task on it (and by this I mean the Auditor General). And I do think that PCO has a point in that the intent of the PBO was to give independent analysis, particularly of economic forecasts, and I do think that there is some merit to the criticisms that Kevin Page had become something of a showboat and was far exceeding his mandate before his term was not renewed. We have a serious problem in our parliament where we are handing too much power to these independent officers (and other appointed bodies for that matter) while MPs are doing less and less actual work – especially the work that they’re supposed to be doing.

While PCO says that the provisions in the budget bill were to try to “strike a balance” with the role of the PBO, I fear that he’s already become too popular with the media – and by extension the general public – to try and constrain his role, and the government will be forced to back down. Because We The Media are too keen to be deferential to watchdogs (like the Auditor General) and not call them out when they go wrong (like the AG did with the Senate report), I fear that the pattern will repeat itself with the PBO, as it already is with the demands from the pundit class that he be given overly broad powers with his new office. Because why let Parliament do the job it’s supposed to do when we can have Independent Officers do it for them?

QP: Refusing an answer

On a busy caucus day, with most of the benches full, it was a question as to how much cheap outrage would be wrought in QP. Rona Ambrose led off, railing about the Infrastructure Bank, to which Justin Trudeau insisted that people were eager for infrastructure investment. Ambrose moved onto Bombardier and the loan given to them despite the misgivings about their governance. Trudeau noted that they gave a repayable loan I order to guarantee good paying jobs. Ambrose changed topics again, denouncing government plans to gut a private member’s bill on bail reform (which, I will note, the legal community is against), and Trudeau insisted that he felt for ten widow of the constable the bill was named after, which was why he was pleased the committee took the study of the bill seriously. Ambrose was outraged, but Trudeau reiterated his response. Ambrose gave it an angry third try, but didn’t get a different response. Thomas Mulcair was up next, worrying about media reports that a former Ontario Liberal cabinet minister was going to be named as the new Official Languages Commissioner. Trudeau noted that there was an independent process, but didn’t confirm or deny the story, only that there would be an announcement in the coming days and weeks. Mulcair tried again, got the same answer, and then moved onto the job postings for the Infrastructure Bank, which has not yet been created. Trudeau simply talked about the need for new infrastructure, but didn’t address the concerns. Mulcair railed about the problem, and Trudeau noted the broad consultations that they undertook with the design of the Bank.

QP: Attempting a defence pivot

After the introduction of the five new MPs who won the recent by-elections — who were introduced into the Commons in the proper fashion (which doesn’t always happen), and QP got off to a very delayed start. Rona Ambrose led off, worrying that Harjit Sajjan didn’t attend a veterans dinner to apologise to them personally. Justin Trudeau noted that Sajjan unveiled the new defence policy today, and slammed the previous government for not spending enough on the military, to many cries of outrage by the Conservative. Ambrose railed about how the Liberals don’t respect the troops, but Trudeau insisted that his government was going to fix the problems of the previous government. Ambrose concerned trolled about Sajjan’s reputation with the troops, and Trudeau accused them of talking a good game with supporting the troops but not following through. Ambrose tried again, and Trudeau insisted that they were leading the way with restoring the Forces. Ambrose tried another helping of concern trolling, and got the same answer. Thomas Mulcair was up next, concerned about our dropping World Press Freedom index ranking and wanted protection for sources. Trudeau said that they believed in that protection, and Mulcair dropped mention of the VICE journalist fighting the RCMP in court, before barrelling along to his prepared question about the old Bill C-51. Trudeau noted the report released and that they would change the legislation in the coming months. Mulcair then called on Trudeau to personally call Putin about gay men being persecuted in Chechnya, but Trudeau did not commit to doing so, just to better sponsorship for LGBT refugees fleeing persecution. Mulcair accused the government of not doing enough, particularly with emergency visas, and Trudeau spoke about the need for permanent solutions to help refugees, not temporary ones.

Roundup: Leaking cabinet confidences is a Big Deal

I will readily admit that I haven’t been keeping as close of an eye on the whole drama surrounding the suspension of Vice-Admiral Mark Norman from the post of vice-chief of defence staff, and the alleged leaks surrounding the contract to refit a supply ship for our navy (which currently has none, thanks to consistently bungled procurement processes). It wasn’t until this particular walkthrough from Murray Brewster that the elements of the story all started to crystalize, in part because we finally got some more details about just what was being alleged thanks to a judge ordering the release of information. Over the past couple of days, the extent of those backchannel conversations with certain shipyards and their aim – to use media leaks to publicly pressure the government to go a certain route when they were resistant – may seem like pretty insider stuff, but it actually has some pretty broad implications for our entire Westminster-system of government.

While you may have certain pundits who bemoan the case against Norman is thin gruel, especially in light of the whole lack of convictions in the ClusterDuff affair, I have to say that leaking cabinet confidences is probably a little more significant. As noted parliamentary scholar Donald Savoie notes in this piece, Cabinet secrecy underpins our entire system of government because it relies on government to act with one voice, and to stand and fall in unison rather than with ministers as individuals. Cabinet solidarity is a Thing, and it’s an important Thing. Cabinet secrecy ensures that there can be a full airing of views and that it’s not just a focus group for the prime minister, and this extends to the advice that the civil service is able to provide. There needs to be a certain amount of secrecy to that advice so that there can be a meaningful back-and-forth of ideas and discussion before a political decision can be taken, and then held to account.

What Norman allegedly did was to use his position as a servant of the Crown, who swore an oath to the Queen and not the government of the day, to further his own interests. He was taking the political decision, and allegedly leaking those cabinet confidences in order to force the situation toward his desired outcome. That not only violates the roles of the civil service (and military by extension), but it undermines cabinet government. We The Media may grouse about the extent to which things are declared cabinet confidence, but it is important – particularly because this government is practicing cabinet government more than its predecessors have been, or even many of the provinces. I’ve had conversations with current ministerial staff here who used to work at Queen’s Park who have attested that cabinet government is real here, unlike Ontario, where it was all controlled from the centre. Leaking confidences undermines this, and it is a serious matter – not just the thin gruel that some would have us believe.
